« John Simpson - BBC Degenerate | Main | 18 Year Old Kidnaps Two Children For Use In A "Demonic Ritual" »
November 28, 2005

Chilling of Dissent, Courtesy of John McCain

Two Washington State DJ's have been deemed to have run afoul of McCain-Feingold campaign contribution laws. The offense? By railing against proposed gas tax increases, they (and their station) were making "in-kind" donations to, I guess, political groups opposing the increases.

They used to call it "free speech" or "entering the marketplace of ideas." Now it's called an "in-kind campaign contribution" and "potential crime."

Wow. Remember when we used to actually voice our opinions publicly, before John McCain wisely took that alleged "right" away from us, in an effort to "increase democracy." (Try to find that made-up fakey "right" in the Constitution!)

[T]he radio station had to put a dollar value on what the hosts had said. The estimate of that in-kind contribution of $100,000 of airtime was reported as a campaign donation under state law.

...

In other words -- in the name of campaign finance "reform" -- free speech no longer is free. If that ruling withstands appeal, especially if it reaches the U.S. Supreme Court, it would have profound ramifications for media nationwide.

...

If this ruling is not struck down, anytime anyone in the media (including the Internet) decides to speak out on an issue, it could be considered an in-kind contribution.

And if federal or state election laws limit the amount of money that can be donated to candidates or causes, the mere mention of an opinion could be estimated (by the government) to be worth the maximum dollar amount allowed to be contributed and thereby prohibit any other reference regarding the subject.
...

[I]f McCain and others get their way, there could be new legislation further rationing free speech to limit the First Amendment rights of the 527 nonprofit groups.

When the government -- and that means politicians who will do whatever they can get away with to preserve and increase their political power -- wants to silence its critics, it will do so.

But unlike in a dictatorship, it will be done very subtly, bit by bit, all in the name of reform, good government, cleaning up politics or whatever else a gullible citizenry will swallow.

Allow politicians to put a price on free speech and then keep your mouth shut when you discover it's more than you can afford.

Bear in mind, John McCain has always been a very thin-skinned politician. I can't help but he's rather pleased that the riff-raff may soon be limited to how many criticisms of him they may make.

The McCain-Feingold Campaign Finance Reform Act

We had to destroy the village in order to save it.

Meanwhile... McCain is said to be increasingly palatable to Republican voters.

Except, of course, the actual committed base. Nominating McCain would rip the party in two.

To this day I am astounded and appalled that the McCain-Feingold bill passed constitutional muster in SCOTUS. What in hell were they thinking?

Posted by: Steven Den Beste on November 28, 2005 12:58 PM

Uh, I don't think you should ever use that phrase without pointing out that Peter Arnett made the whole thing up.

Posted by: someone on November 28, 2005 12:59 PM

It will be interesting to see how the Roberts court with the addition of Alito will interpret the phrase "Congress shall make no law..."

As for McCain getting the 08 nomination, one thing is for sure it will probably guarantee that I end up violating BCRA.

Posted by: Stephen Macklin on November 28, 2005 12:59 PM

So, at this point, we crack down on Limbaugh, Franken, et. al., and start earning that sweet, sweet free speech beef by selling soapboxes on 42nd. Street?

(Not for nuthin, but watch out for those "Lost Tribe" guys wearing all the leather and studs.... I mean, puhleeze!...)

Posted by: TC@LeatherPenguin on November 28, 2005 01:00 PM

Oh, I think there's zero chance McCain gets the nod. The press loves him, so they exaggerate his fortunes. The Republican base loathes him, and nobody takes the primaries without his party base.

Posted by: S. Weasel on November 28, 2005 01:02 PM

Weasel's right...look what happened when they gleaned on Dean.

Posted by: TC on November 28, 2005 01:07 PM

In the last WSJ/CNN poll, something like 20 percent of Republicans said they wouldn't vote for McCain--not in the primaries, not in the general election, not under any cicumstances whatsoever. The man's negatives are astoundingly bad.

I don't like the man, and I detest McCain-Feingold, but the visceral loathing a lot of the party base feels for McCain has always been a little mysterious to me. In fairness, it's no more mysterious than that Tiger Beat crush most of the national media feels for him.

Ixnay on the Ickainmay, guys. You want Ace to have to pay a fine or something?

Posted by: Sean M. on November 28, 2005 01:26 PM

Utron? At least my from my experience, here the explanation why this piece of crap should be thrown on a pile of scrap:
Viet vet: god bless, but so what? I've been shot and stabbed but that doesn't make me King High when talking about it or what should be done to stop it. And that he and Froggy Kerry conspired to make nice with the ruling Viet while shoving under the rug a boatload of POW questions paints his butt in an unsightly color.

Keating Five: in my book, you are damn well GONE from the "money" conversation. You should not be allowed to even SEE the table, nevermind sit at it.

I have to admit. I have MDS.

Posted by: polynikes on November 28, 2005 01:37 PM

McCain his done an excellent job of showing his true colors. Conservatives will not be fooled.

Posted by: Nickie Goomba on November 28, 2005 01:59 PM

Uh, I don't think you should ever use that phrase without pointing out that Peter Arnett made the whole thing up.

Arnett may have made up the phrase and the Tailwind bullshit, but My Lai wasn't made up. Granted, the massacre was an isolated incident perpetrated by some sick bastards, but it did happen.

Posted by: Sue Dohnim on November 28, 2005 02:44 PM

Living in the Seattle area, I can tell you that the campaign finance attack on Kirby, John, and KVI has wholly to do with protecting the entrenched legacy government here, and little to do with the guys themselves. Seattle is the next Chicago, is the next New Jersey. The rest of the state is desperate to quarantine Seattle's policies to Seattle. Heck there is even a movement to split off suburban King County from Seattle and create a new county. Happily even traditional libs are getting fed up with the legacy government here as witnessed by Rossi's close race and the passing of local agitator Tim Eyeman's iniative.

I've got several domestic policy disagreements with McCain, but I'm really pretty much a one issue voter right now when it comes to electing the Commander in Chief of this country. While I would probably prefer Condi Rice or Giuliani, McCain looks a hell of a lot better than anything out there in the Democratic Party. George Allen and Mitt Romney are really non-starters for me.

Posted by: NCVOL on November 28, 2005 03:19 PM

Sue, the quote had nothing to do with My Lai. And oh, yeah

It wasn't the United States that destroyed Ben Tre (a town, not a village), but the Vietcong.

Posted by: someone on November 28, 2005 03:48 PM

I do agree that Peter Arnett should go shark hunting in sirloin suit.

Posted by: Sue Dohnim on November 28, 2005 04:24 PM

Who needs McCain when you have Joe Lieberman.

Lieberman wrote an editorial for the WSJ.
Our Troops Must Stay --

America can't abandon 27 million Iraqis to 10,000 terrorists.

Here is an ironic finding I brought back from Iraq. While U.S. public opinion polls show serious declines in support for the war and increasing pessimism about how it will end, polls conducted by Iraqis for Iraqi universities show increasing optimism. Two-thirds say they are better off than they were under Saddam, and a resounding 82% are confident their lives in Iraq will be better a year from now than they are today. What a colossal mistake it would be for America's bipartisan political leadership to choose this moment in history to lose its will and, in the famous phrase, to seize defeat from the jaws of the coming victory.

Check it out.

McCain's long descent from war hero to authoritarian, egomaniacal blowhard and busybody has not been pretty. It mystifies me that any Republican can consider him presidential timber.

Posted by: Axel Kassel on November 29, 2005 12:05 PM

Here's a terrifying thought for the next presidential election - Hillary vs McCain. Talk about not having a vote. That would definitely be a reason for 3rd party or writein candidate. However, I agree that McCain is not likely to be the Republican candidate.

Posted by: docdave on November 29, 2005 01:19 PM

Anybody read Lieberman's piece in WSJ that I linked in this thread lastnight?

P.S. Fuck you, Tubino, again.

Posted by: Bart on November 29, 2005 02:59 PM

What is anyone actually going to do about the overthrow of the Constitution? Is McCain's revolution any less revolutionary for being a creeping revolution? Are we ever permitted to say that the men who were once our constitutional officeholders have rebelled against constitutional government? What ought to be done about rebels who continue to wear the name of "Senator"?

What is the UK Regime's plan for protecting the citizens from the savage criminals they've foisted on the populace? They offer NONE. They do, however, have a plan for protecting the savage criminals from the citizens: The citizens must STAY CALM and not get angry and not share videos of citizens being attacked by savage criminals.
The public keeps saying "protect us from the foreign savages you have imported against our wishes and over our objections" and the UK branch of The Regime keeps proposing plans to protect the foreign savages from the public. Soclose to what the public is demanding, just, you know, the complete opposite.
Just a thought: Maybe you wouldn't have to worry about the public attacking the savage criminals if you actually introduced a plan to protect the public from the savage criminals. Maybe they wouldn't feel as if it was necessary for them to protect the public through self-help.
