Two Washington State DJ's have been deemed to have run afoul of McCain-Feingold campaign contribution laws. The offense? By railing against proposed gas tax increases, they (and their station) were making "in-kind" donations to, I guess, political groups opposing the increases.

They used to call it "free speech" or "entering the marketplace of ideas." Now it's called an "in-kind campaign contribution" and "potential crime."

Wow. Remember when we used to actually voice our opinions publicly, before John McCain wisely took that alleged "right" away from us, in an effort to "increase democracy." (Try to find that made-up fakey "right" in the Constitution!)


[T]he radio station had to put a dollar value on what the hosts had said. The estimate of that in-kind contribution of $100,000 of airtime was reported as a campaign donation under state law.

In other words -- in the name of campaign finance "reform" -- free speech no longer is free. If that ruling withstands appeal, especially if it reaches the U.S. Supreme Court, it would have profound ramifications for media nationwide.

...

If this ruling is not struck down, anytime anyone in the media (including the Internet) decides to speak out on an issue, it could be considered an in-kind contribution.

And if federal or state election laws limit the amount of money that can be donated to candidates or causes, the mere mention of an opinion could be estimated (by the government) to be worth the maximum dollar amount allowed to be contributed and thereby prohibit any other reference regarding the subject.

[I]f McCain and others get their way, there could be new legislation further rationing free speech to limit the First Amendment rights of the 527 nonprofit groups.

When the government -- and that means politicians who will do whatever they can get away with to preserve and increase their political power -- wants to silence its critics, it will do so.

But unlike in a dictatorship, it will be done very subtly, bit by bit, all in the name of reform, good government, cleaning up politics or whatever else a gullible citizenry will swallow.

Allow politicians to put a price on free speech and then keep your mouth shut when you discover it's more than you can afford.

Bear in mind, John McCain has always been a very thin-skinned politician. I can't help but he's rather pleased that the riff-raff may soon be limited to how many criticisms of him they may make.

Except, of course, the actual committed base. Nominating McCain would rip the party in two.

It will be interesting to see how the Roberts court with the addition of Alito will interpret the phrase "Congress shall make no law..."

As for McCain getting the 08 nomination, one thing is for sure it will probably guarantee that I end up violating BCRA.

Oh, I think there's zero chance McCain gets the nod. The press loves him, so they exaggerate his fortunes. The Republican base loathes him, and nobody takes the primaries without his party base.

In the last WSJ/CNN poll, something like 20 percent of Republicans said they wouldn't vote for McCain--not in the primaries, not in the general election, not under any cicumstances whatsoever. The man's negatives are astoundingly bad.

I don't like the man, and I detest McCain-Feingold, but the visceral loathing a lot of the party base feels for McCain has always been a little mysterious to me. In fairness, it's no more mysterious than that Tiger Beat crush most of the national media feels for him.

Living in the Seattle area, I can tell you that the campaign finance attack on Kirby, John, and KVI has wholly to do with protecting the entrenched legacy government here, and little to do with the guys themselves. Seattle is the next Chicago, is the next New Jersey. The rest of the state is desperate to quarantine Seattle's policies to Seattle. Heck there is even a movement to split off suburban King County from Seattle and create a new county. Happily even traditional libs are getting fed up with the legacy government here as witnessed by Rossi's close race and the passing of local agitator Tim Eyeman's iniative.

I've got several domestic policy disagreements with McCain, but I'm really pretty much a one issue voter right now when it comes to electing the Commander in Chief of this country. While I would probably prefer Condi Rice or Giuliani, McCain looks a hell of a lot better than anything out there in the Democratic Party. George Allen and Mitt Romney are really non-starters for me.

Here's a terrifying thought for the next presidential election - Hillary vs McCain. Talk about not having a vote. That would definitely be a reason for 3rd party or writein candidate. However, I agree that McCain is not likely to be the Republican candidate.

What is anyone actually going to do about the overthrow of the Constitution? Is McCain's revolution any less revolutionary for being a creeping revolution? Are we ever permitted to say that the men who were once our constitutional officeholders have rebelled against constitutional government? What ought to be done about rebels who continue to wear the name of "Senator"?

Correction: I wrote that Labour is losing 88% (now 87%) of the seats it is "defending." I think that's wrong. The right way to say it is the seats they are contesting -- that is, they don't necessarily already hold these seats, but they have put up a candidate to run for the seat. It's still very bad but not as bad as losing 87% of the seats they already held.

STARMERGEDDON: In early returns, Reform gains 135 seats, Labour loses 90, the Fake Conservatives lose 36 (and I didn't even know they could fall any further), the Lib Dems lose 4, and the Greens gain 6. Note that the only other party gaining seats is the Greens and they're only gaining a handful of seats.
Update: Reform now up 145, Labour down 98.
Labour projected to lose Wales -- where they've ruled for 27 years.

I'm sure it's not this simple, but Reform is straight taking Labour's and the "Conservatives'" seats. They've lost almost exactly what Reform gained. If understand this right (and warning, I probably don't), all of London's council seats are up for election, and Labour might lose hugely there, as their old voters abandon them for Reform, Muslim Indenpendents, and the Greens.

Updates on the Labour collapse in council elections -- which wags are calling #Starmergeddon -- from Beege Welborne. There are about 5000 seats up for grabs, Labour is expected to lose 1,800, Reform will probably gain 1,580, up from... zero. So this would be more than that.
People claim that while Labour has adopted the Sharia Agenda to appeal to the million Muslims it allowed to migrate to the country, those voters are ditching Labour to vote for the Muslim Independent Party or the Greens. Delicious. This shadenfreude is going straight to my thighs.
Oh, and if Starmer loses about as badly as expected, Labour will toss him out of a window Braveheart style and replace him. He will announce he is resigning to spend more time with his Gay Ukrainian Male Prostitutes.

I always thought the gag was original to the comic book, but in fact the "Threat or Menace" headline was a satirical joke about media bias and sensationalism for a long while. The Harvard Lampoon used it in a parody of Life magazine: "Flying Saucers: Threat or Menace?"
