Although the Dems are panicky on this right now (witness that shrewd move in the House yesterday on the Ethics Committee rules - nice move from the R's), I don't see any reason to think they'll honor that deal when Bush offers his first nominee for the SCOTUS.

But, Republicans can always say "you went back on your word" and see if they have the guts to go the rule change route. Obviously the Dem play would be "yeah yeah, but you're changing all those rules to get your way and this pervert is SO extreme that we just couldn't in good conscience blah blah blah".

Part of the problem is that the word filibuster has been diminished to mean just obstructionist tactics. Gone are the good old days of endless speechmaking . . . and cobbler recipes.

It would be wrong to bargain away the rights of 2 of the proposed justices to an up or down vote. To do so would be to seemingly accept that the dems were correct about their "right-wing activist agenda" crap and allow the dems to crow about saving the courts from the worst of the nominated candidates. Frist should do just as he is doing. If he keeps it up he might actually develop a spine and a personality.

He has the votes and has had them all along. He doesn't have to offer Reid anything. None of the judicial nominees are extreme, and none should be withdrawn.
