Frist Offers "Fair Compromise" On Judges

And I'm not complaining about it.

In exchange for giving up filibustering judicial nominees, the Republicans would offer...

a) Guaranteed up-or-down votes on nominations for Circuit Courts of Appeals and Supreme Court nominees.

b) Guaranteed debate time of up to 100 hours for those nominees.

c) Guaranteed reporting of nominees from the Senate Judiciary Committee to the Senate floor.

d) Guaranteed protection of the legislative filibuster.

A-hem.

NRO also prints the whole Frist speech laying out the, um, compromise.

NRO speculates that the Democrats will only consider this, errrm, compromise if the GOP agrees to withdraw some/most of its current nominees (i.e., allow the previous filibusters to succeed, forever), but Frist claims he will not budge on them.

It seems to me that with a couple of exceptions -- Janice Brown first among them -- that might not actually be a bad trade. Yes, the previous nominees are qualified and should be allowed to serve, but... if we really could end filibusters on all future nominees, that might not be a half-bad deal at all.

"There's a war on" Update: Jason reminds me that none of this is important. Why? Well, read the slugline of the update, dope. There's a war on. Or had you forgotten?

This isn't important. There's a war on.

Although the Dems are panicky on this right now (witness that shrewd move in the House yesterday on the Ethics Committee rules - nice move from the R's), I don't see any reason to think they'll honor that deal when Bush offers his first nominee for the SCOTUS.

But, Republicans can always say "you went back on your word" and see if they have the guts to go the rule change route. Obviously the Dem play would be "yeah yeah, but you're changing all those rules to get your way and this pervert is SO extreme that we just couldn't in good conscience blah blah blah".

Is anyone paying attention to Betsy?

Part of the problem is that the word filibuster has been diminished to mean just obstructionist tactics. Gone are the good old days of endless speechmaking . . . and cobbler recipes.

There's this, too;
what after all of this have the Democrats really gaied, if after even the rules being changed back to their advatage, they still are unable to pin anything on their great satan, Tom Delay?

It would be wrong to bargain away the rights of 2 of the proposed justices to an up or down vote. To do so would be to seemingly accept that the dems were correct about their "right-wing activist agenda" crap and allow the dems to crow about saving the courts from the worst of the nominated candidates. Frist should do just as he is doing. If he keeps it up he might actually develop a spine and a personality.

Frist is saying, 'If you'll stop filibustering judges, we'll let you.' Seems like a fair compromise.

He has the votes and has had them all along. He doesn't have to offer Reid anything. None of the judicial nominees are extreme, and none should be withdrawn.

Yes... that's the way it seems to me, which is why I said "no comment."

I don't want to admit this isn't a compromise at all.

My official position is that we're bending over backwards to meet these people half-way.

That's my story and I'm sticking to it.

They rejected it, I'm shocked.
