WH to Accept McCain Anti-Torture Plan, With AdjustmentBig mistake. The moral preeners forced this mistake on Bush, who once again folded in the face of pressure. There is a tiny bit of wiggle-room added: Under the emerging deal, the CIA and other civilian interrogators would be given the same legal rights as currently guaranteed members of the military who are accused of breaking interrogation guidelines, these officials added. Those rules say the accused can defend themselves by arguing it was reasonable for them to believe they were obeying a legal order. But that pretty much ends any useful intelligence from Al Qaeda terrorists. They now know that Americans can't even belly-slap them, let alone put fake blood on them. Yeahp. Now what was that you were saying earlier about McCain's GWOT credentials? All kidding aside, I don't doubt (much) that people like him want us to win. I just doubt their ability to do (or allow others to do) what is required to win. There is a gray area between torching the constitution in service of winning the war, and making victory more difficult than it needs to be. Of course, we could just act like the French - sign up to every treaty to come down the pike and then just say fuck it and do whatever the hell we want anyway. Of course, there is the minor problem that ratified treaties can be enforced in domestic courts... On the other hand, one can expect that AQ will start briefing their guys on what to expect in light of this - and it will be a rude surprise the first time the interrogator goes outside the rules, preferably with a pre-signed presidential pardon in his pocket. The pissing contest between Glenn Reynolds and Andrew Sullivan just got a little more fun. I don't think I really agree with Mark Levin, Rich Lowry, et al. on the specific subject at hand, though I confess that I haven't followed that particular pissing match very closely. However, I do agree with them that Andrew has been consistently, pompously, and annoyingly moralistic and irritatingly unspecific. So if that's the chorus, well yes -- but it's a song that has a lot of notes, most of them struck by Andrew himself. And I'm irritated with him, not for the reason you might think -- because I disagree with Andrew -- but more the contrary, because every time I read one of his preening posts, I find my opposition to torture weakening in response, even though I've been consistently in opposition to torture since 2001 (and before). God help me if he ever starts blogging in support of nanotechnology and bans on cloning -- I'll probably start looking at Leon Kass more sympathetically. It's like listening to Robert Bork talk about original understanding jurisprudence.The slapdowns of Excitable just grow more and more public. By the time Andy finishes his preening, he'll have about a dozen readers left, and no one linking to him. But that'll just make him all the more independent.
