DeLay IndictedAs they say, a prosecutor can indict a ham sandwich. Unless that ham sandwich is named "William Jefferson Clinton," of course. Bill Clinton is the Rollo Tomase of American politics. In better news, Bill Frist's statement about his sale of HCA stock noted that he had initiated the process of selling in April, before the July (I think) sale went through. This distance between beginning the sale and the trustees' execution of it makes it seem less likely that he was acting on insider information of a very time-senstive nature. Apparently he wanted to sell long before that bad quarterly report; it just took a lot of time to have the sale cleared by the Senate Ethics Panel and such. posted by Ace at 01:46 PM

Who cares. The man is going to be found guilty by O'Dub, the NYT, MSNBC, Jesse Jackson, Kos and his minions, etc. Already, both sides are already making this a political battle, with those on the right assuming Earl's motive is purely political. Sharp is right, so many people are going to make judgements about the case without knowing any of the facts. All we can really do is watch the process and see what happens. Ace, do you know much about stock trading? The fact that the sale took two months to execute does not imply what you said it would. As you know Frist owned a fairly large portion of the stock and that is not something that can be sold overnight. I personally don't want to make judgements about the case, but the few successful stock traders I've known have all been using insider informtation - it happens way too often and it is just the nature of the game. That is why many thought the Martha Steward case was simply ridiculous since if we put all people involved in insider trading in jail, well you get the picture. Of course you can keep believing that the stock market is a clean fair game, but whatever. Every once in a while someone gets nabbed and if it happens to Frist, then so be it. It may be that this is just an ongoing local (Texas) political fight between a DA and a Congressman who have different views of the world. But if he's guilty I hope he's punished to the fullest extent of the law. (And before anybody questions my conservative bona fides please read some of my other comments.) Ronnie Earle's (Travis County DA) track record on Republican hit jobs is poor. Ok, that's kind, he's never gotten a conviction. If Delay broke a Texas law, then too bad Tom. Disclosure: Delay is my congressman and I have known him and his family for years. This is a politically motivated indictment- Earle did the same thing to Kay Bailey Hutchinson and NOTHING came of his witch hunt. The TX legislature gave jurisdiction to indict anyone Earle, DA in Travis County and only elected by those in Travis County, pleases instead of giving it to the State Attorney's office - who is elected state wide. Now...anyone who knows about Texas knows it is a red state to the core - except for Travis County (Austin area). This is where the loons live in Texas. It was a total culture shock for me when I went to college. This is what concerns me about this whole thing...people in Travis county HATE, and I mean H.A.T.E., Delay. Chris Brown (former democratic congressman) has been thowing a hissy fit ever since the redistricting in Texas because he lost his seat- He blames Delay...this is what the ethics investigation last year was about. Look for this dude to be on ever talk show, quoted in every newspaper, and basically become a media darling. Delay is hated by the Dems because he is effective in his job. Effective at passing conservative legislation, effective at raising money for the party, effective at getting other Republicans elected, etc. They can't stop him, so they have chosen to destroy him. Republicans have taken a one, two, three, four punch lately (Iraq war, hurricanes, pledging an ungodly amount of money to rebuild a city 12 feet below sea level, indictments) . Here's a copy of the indictment. The gist seems to be that various corporations gave money to TRM-PAC, which then gave it to the RNC, which then gave it to 7 Texas candidates. This is allegedly illegal because it was w/in 60 days of an election, and/or the donations came from corporations. The indictment is a little strange: it spells out the (alleged) roles of Coylandro and Ellis in detail regarding their handling of the money, but there's nothing about Delay's (alleged) involvement at all. If there's no actual claim of wrongdoing on DeLay's part in the indictment, then the DA is going to claim it's a conspiracy (obviously) and one of the conspirators has flipped. Watch this come down to jury selection--whether DeLay can find a jury unwilling to buy the story of a co-defendant testifying for a lighter sentence. If he broke the law, he should pay. Simply getting the state re-gerrymandered to match the current political makeup, however, isn't a hanging offense, let alone a violation of the law. Even if he didn't break the law, he should still be set stratight on his entire "the government's as lean as it can be, honest!" moron-speak.
