Blogger Indicted for "Intimidating" a Witness

I don't know all the facts necessary to make some sort of a judgment about this, but it seems interesting.

The indicted blogger fisks the article and his indictment at -- where else? -- his blog.

As is the case with some pro se litigants, this one seems to have a partially educated view of the law and Ohio's legal system, and the lack of an accurate understanding leads to analysis that is partly true, simply wrong, or just plain bizarre.

It's entertaining, though.

It would also help if he'd actually provide a link (may or may not be possible) or a scan (more likely) of his indicment, so we can judge for ourselves.

If the authorities were really out to get him, they wouldn't have been nice enough to issue a summons on indictment, just for starters.

I hope he actually gets a good, experienced local defense attorney and then LISTENS to said defense attorney. Otherwise he might turn a defensible case (note: not a sure winner, or a sure loser) into something worse.

Also, a witness can be intimidated before, during, or after his testimony. So long as the proceeding has not concluded (i.e. a witness could be recalled), intimidation would be appropriate.

Mind you, even if it's afterwards, the related charge of retaliation would then apply.

See Ohio Revised Code Sections 2921.03 (Intimidation), 2121.04 (Intimidation of attorney, victim or witness in criminal case), and 2921.05 (Retaliation).

I'm guessing his indictment is for 2921.03. Also, indictments don't have to be terribly specific, so he's probably wrong on that score too.

Get a load of the "probation requirements" in that lady's case:

a) Movant can not report any wrongdoing by any private citizen;

b) Movant can not press criminal charges despite the fact that Ohio law permits any citizen to press charges in Ohio Municipal Courts;

c) Movant can not discuss the law with any person;

d) Movant must submit to a forensic psychiatric examination (which she did) for treatment of judge diagnosed "paranoid apprehensions" despite the fact that she was convicted of knowingly making false statements about public official Kevin Baxter in a public proceedings a non crime barred by the First Amendment. (See RC. 2725.02 and RC 2725.04 providing original jurisdiction to this honorable court and Sup. Prac. R. X that provides that a motion for a Writ of Habeas Corpus is a statutory proceeding solely governed by Chapter RC 2725.01 et seq. of the Ohio Revised Code).

I'm no lawyer - but that's bullshit!!!

OKay the kid is criticizing a prosecutor, and he passes a note to a guy who who the kid claims is in cahoots with the prosecutor to fix the case he's covering for his blog. The prosecutor then charges the kid with "intimidation"
