I know that lots of law-talking folks frequent this blog, so a question: how does McConnell stack up to Luttig? I don't know much about McConnell, but he seems to be well-thought-of and is a strict constructionist by all accounts.

McConnell is good, but he's had fewer opportunites to prove it (novel Constitutional questions don't often arise out of the 10th Circuit).

Related: Does anybody remember the addresses of those great parody sites purportedly by those disappointed judges passed over for Miers? This is a good time to re-kindle.

McConnell is an odd duck, an academic with some wierd ideas (possible constitutional right to polygamy, etc.). Professors love him tho, even the lefty ones.

That's why I'm hoping for a Luttig nod, although I'd be happy with Janice Rogers Brown too: both are very smart, capable jurists but have very "textualist" views (in Scalia's sense). A big donnybrook in congress might be just the tonic everyone needs to get rid of the bad blood.

It'll be interesting to see if the donks try to filibuster. I'm pretty sure they'll try with a Luttig or a Brown nod, so I'll be equally interested to see if the Republicans will break the filibuster.

Whatever happens, you're going to see some truly nasty stuff coming out of the Left. They've been holding fire while the conservatives were fighting amongst themselves, but that self-imposed cease-fire is over as soon as W. nominates his next pick.

Monty, only time will tell, but I hope you're right.

Bush tried to play it safe and he watched his approval ratings go down the toilet. Did he LEARN? Don't know yet...but one thing's for sure; if we Republicans had ALL played it SAFE -- like some of the posters here and elsewhere were suggesting, ahem -- then Bush definitely would not have learned SQUAT.

And, once again, that goes double for Congress.

Note to the Republican leadership: STOP BEING PU$$IES! because being pu$$ies has just made your numbers go South.

I believe this “uprising” was the best thing that could have happened, not only for the hirelings in the Senate but for the conservative movement in particular.
We stood up and made it known that we weren’t happy with the Meirs nomination and they paid attention, especially the libs.

I believe we will get a nominee this time that will either provoke a filibuster and a constitutional smack-down or we will know exactly who is a RINO and who isn’t.

Forget it. If it was okay to dig up 15 year old speeches to use against Miers, you can expect it to be done against the next nominee. However, it will be the democrats doing it and you will be in no position to complain. You thought it was fair to attack Miers for trying to get more minorities on the various boards in the Texas State Bar. Now you can expect similar chicken shit charges against the next nominee by the dems, and you won't be able to complain about that either.

When a party wins, it is because a number of people crossed over or because people who are in the middle decided for one party over the other. But if you are going to be holding litmus tests, forget it. Let me repeat myself: I don't give a shit about Roe v Wade. It is a dead issue. It is not going to be overturned. I disagree. The lowest that the MSM have been able to push his approval rating is still 40%. And that was with half of the conservative base whining about Meiers.

I think Bush has gotten the message though. He's now all kissy-kissy with the fiscal conservatives (we'll see if he follows through though) and if his next appointee to the SCOTUS is some they can respect then you'll see those poll numbers jump back over 50 and probably flirt with 60.

How I feel about abortion and how I feel about Roe are two entirely different things. Abortion is a complex issue, Roe is a simple one. Roe is the decision where the court most clearly went from interpreting the Constitution to "making shit up." We can't stand a whole lot of that and stay America.

Get rid of Roe, and then we can have that conversation about abortion. Together. As an electorate. Like we were doing before the courts butted in.
