Against whom, we don't know. We do know that McCabe lied -- or, per his own admission, accidentally made false statements, and did so, per Representative Jordan, four times, each more accidentally than the last time -- and so it could be that McCabe is being criminally referred.
We don't know. We also can't know for sure that Carter's sources are 100% right about this. Reports do change.
We do know that McCabe is shaking the tin cup for his legal defense fund on Go Fund Me and has collected $440,000+ so far.

It is not clear what information Clapper discussed with media outlets, but he was involved in a highly significant meeting with President Donald Trump just two weeks before the Republican’s inauguration.
Clapper and three other top intelligence community officials-- then FBI Director James Comey, then CIA Director John Brennan, and National Security Agency Director Mike Rogers-- briefed Trump on Russia’s efforts to meddle in the 2016 election.

The briefing took place and Trump was told about the dossier, CNN reported on Jan. 10, 2017. Hours later, BuzzFeed News published the dossier in full. Trump reportedly believes that the Comey briefing was a setup aimed at providing justification to release the dossier.
Clapper directly denied last week that he had contact with the media prior to leaving office on Jan. 20, 2017.
That's not what Sara Carter's sources say. They say the investigation revealed that Clapper leaked to CNN "early last year."
Former Director of National Intelligence James Clapper allegedly leaked information to CNN early last year regarding the classified briefings given to then President-Elect Donald Trump and President Barack Obama on the salacious dossier claiming the Russians had compromising information on the president-elect, according to government sources, who noted the evidence of the leak was collected during the House Intelligence Committee’s Russia investigation.
Clapper, who was one of four senior Obama administration officials to attend the briefing with the presidents, also stated his "profound dismay at the leaks" in an official statement issued in January, 2017 and warned that the leaks were "extremely corrosive and damaging" to national security, according to his press release.
