Deep State Mafia Boss Anthony "Little Bones" Fauci Pleads the Fifth

This is what I thought he would do.

But now I wonder if he has any legal right to invoke the Fifth.

He was pardoned for all crimes he committed for a ten (or eleven?) year period, 2014 to 2024. Therefore, speaking about his activities then does not incriminate him as he cannot be prosecuted. He could admit the broke every law in America, but that's not self-incrimination, because he can't be prosecuted for what he says.

He could be prosecuted for crimes since then, but not for crimes between 2014 - 2024.

When a court or Congress wants testimony from someone invoking the Fifth, they will grant immunity for that testimony, meaning it cannot be used in any other body in the future for purposes of punishing the testifier. Then testimony can be compelled, as there is no Fifth Amendment right just to keep a secret because you want to keep it a secret.

But Congress doesn't even have to immunize Fauci -- Biden's Magic Autopen already did.

So he should be compelled to testify, or be held physically in contempt until he agrees to talk. (I see now other people are talking about this.)

But I doubt the GOP has the balls to do this.

He can also say that his pardon hasn't been accepted by a court as effective.

FAUCI PARDON: NOT BULLETPROOF

On the Pardon: Before the hearing @SenRandPaul
a former senior Justice Department prosecutor told me there are three, viable legal strategies to challenge the preemptive Biden pardon.

But there is no easy path.

One strategy calls for charging Fauci with a crime, with the expectation he would file a motion with the court to dismiss based on the pardon. This could open the door to challenging the sweeping pardon's viability and years of litigation.

Another strategy involves Congress. Because Fauci has theoretically been preemptively pardoned against past and future criminal charges related to his NIH work, it can be argued that Fauci has no plausible claim to the 5th Amendment, the right against self-incrimination.

If Fauci takes the Fifth at Senator Paul's hearing (which he has) the committee could seek to compel Fauci's testimony. A finding of contempt could follow.

Finally, one of Fauci's closest associates has been criminally charged. With pressure and the right incentives he might be flipped and become a cooperating witness.

Dr. David Morens, who was a senior advisor to Fauci at the National Institute of Allergy and Infectious Diseases, was indicted on multiple charges including conspiracy and obstruction, including destruction, alteration or falsification of federal records.

Along with allegations that personal email accounts were used to evade the Freedom of Information Act, this could be a powerful motivator.

From media reports: Dr. David Morens has pleaded not guilty to all five federal criminal counts.

Perhaps surprisingly, both the New York Times and the Washington Post have now published articles on the Fauci diaries. Unsurprisingly, both are complete whitewashes. They sanitize his record and reduce the criticism to the suggestion that he may have been a little too narcissistic.

Neither outlet confronts the diaries' central revelation, which is that Fauci repeatedly said one thing in private and another in public. That applies to the possibility of a laboratory origin, the supposed role of the Wuhan seafood market, the Wuhan lab's extraordinarily dangerous gain-of-function research, the infection fatality rate, dissenting scientists such as Jay Bhattacharya, and much more.

This was their chance to admit that they were wrong to trust Fauci, that he was a charlatan, and that they had failed their readers by acting as establishment propaganda outlets rather than journalists. They could even have blamed Fauci and washed their own hands of the entire scandal.

But they cannot bring themselves to do even that.


Update: Rand Paul thinks that Fauci's destruction of official records is prosecutable. I guess maybe this took place after the period of his super-pardon.
