Happy Wednesday.
The Second Circuit heard argument yesterday about the NSA phone metadata collection program. Shannon Bream has recap, which is the only way you'll hear about it since the Second Circuit remains in the Stone Age and does not make audio of argument available to the public.
Over in the Seventh Circuit, the brief for two of the targets of the partisan John Doe probe in Wisconsin has been filed. If you'll recall, this is an appeals stage of the civil rights lawsuit filed against the John Doe prosecutors for being partisan hacks who set out to stifle the speech rights of conservatives. Legal Insurrection has coverage of the brief, which is arguing in support of the preliminary injunction issued by a judge that halted the John Doe witchhunt. The brief contains one of the most cogent explanations of the affair I have seen.
Switching gears, Vulture has an interesting discussion of how TV has changed in the last 20 years, with a look at just how far the TV-viewing audience for particular shows has shrunk.
The President, who is in Estonia trying to look tough for Putin, was asked twice more about whether there is an ISIL strategy. He has goals ("degrade and destroy"), but still can't say how he plans to do that.
