John Cornyn and Henry Cuellar Propose Compromise on Deportation of Unaccompanied Children at Border

The right (actually, everyone except the open borders movement and partisan/movement Democrats) favors simply striking the distinction between children from Mexico and all other children, and simply sending them back when found at the border.

The Open Borders people want them to have never-ending hearings (which they'll skip, and then get lost in the immigrant community, and then claim "Dreamers" status), and because Obama's hard left allies want this, Obama of course wants it too.

So Cornyn and Cuellar have proposed a compromise, in which each kid would get a hearing before an HHS judge within seven days of their discovery at the border, and then the judge would have three days to decide if the kid has made some kind of bona fide asylum claim.

I think this is a bad deal. Were this bill to be passed, the UC's would simply all begin making claims that they had been sold into sexual slavery, or whatever other hot-button claim they know will get a judge to give them the right to remain in America.

And what is a judge to do, when a kid makes this claim but provides no evidence whatsoever to support it? I don't know what the rules are in cases of a claim-with-no-evidence, but I'm not sure what the rules matter anyway, because there are many judges (or just bureaucratic hacks acting as a judge for these purposes) who will simply find all such claims credible, or, rather, not facially untrue and therefore not within their capacity to judge to be false.

So I think this compromise just means that 80% of the UC's get asylum. The only ones who won't get asylum are those kids who either won't lie or don't lie well, plus some percentage of UC's the judges send home basically randomly to "make the numbers look good" (that is, to avoid the situation in which it becomes public knowledge that 95% of UC's are being granted asylum-- they'll want to make it look better than that).

I imagine Open Borders advocates will inform the kids which stories work best on which judges, and which stories have become suspect due to being claimed so many times, and etcetera.

Given that these kids have undertaken a difficult journey, and are no doubt instructed by their parents that if they can get into America and be declared a "Dreamer," they can then bring over the rest of the family -- does anyone really think they're not willing to tell a minor lie to a judge to accomplish the mission given to them by their own parents?

Meanwhile, Obama's plan to scatter the seeds across America secretly continues. Nebraska's governor, for example, complains that 200 of the UC's have been planted in his state without being told about it by the federal government, nor of being told where the UC's even are.

In a sign of the far-reaching impact of the U.S. immigration crisis and its political fallout, Nebraska's governor says 200 children who entered the country illegally were sent to his state this week without warning and that federal officials are refusing to identify them or their locations.

Gov. Dave Heineman, a Republican, said federal officials also wouldn't answer questions about public school attendance by the children and the potential costs to taxpayers.

"Governors and mayors have the right to know when the federal government is transporting a large group of individuals, in this case illegal immigrants, into your state," Mr. Heineman told The Wall Street Journal in an interview on Saturday. "We need to know who they are, and so far, they are saying they're not going to give us that information."

An Obama administration official on Saturday said the Central American children now in Nebraska aren't at a facility but are being housed with family members and sponsors while they await immigration proceedings. Some of the children arrived in the recent border surge, while others came earlier in the year.

And forgive me for suspecting that they won't show up for any hearing in which the outcome seems likely to run against them, but will instead disappear into those "shadows" we've been endlessly told are the Worst Thing Ever.

While they're the Worst Thing Ever, these shadows always seem to be a Viable Plan B in cases where the open borders lobby can't secure Plan A (dreamer status).
