Most of the time the advisory would be "never put the defendant on the stand." But then, 99% of defendants are guilty.
But...
The jury does hold it against you when you don't. They want to hear from the defendant. They want to hear him say, "I'm innocent," and they wonder about it when he doesn't.
The downside is that the prosecution will get to impugn his credibility as a witness by bringing up things that would normally not be admissible, like prior crimes and prior acts suggesting that he's a liar or an unreliable individual.
But... What negative information is going to come out? That's always the big issue. BUT, we've had a year of negative press about him. What is there more that will come out?
There is a risk of course. there are always Unknown Unknowns. But this isn't a case where you just win on the facts. This is a political case. This is a show trial. He needs to put on a show.
He needs to show he's actually innocent and he needs to show his humanity.
Update: Viva Frei, Rekieta, and the commentator still say this is a bad idea, especially given that the judge just ruled that there will be virtually no limitations on what the prosecution can ask him. They also brought up a series of negative facts that the prosecution will bring up, including an "association" with the Proud Boys, whatever that means. (I didn't know about that.)
My first reaction might have been wrong. I might have been guided more by what I wanted to see and what I hoped that would happen than a sober evaluation of the situation.
We'll see.
Revelation: Kyle's bulletproof vest (which he gave away to a friend for the night) was not purchased but assigned to him by the police. I guess because he was a volunteer medic, maybe. A friend says this is because he was part of the "Police Explorers Program."
Paints a different picture.
He's establishing the owners of Car Source invited him to the lots and gave him a ride there and that he was there with their permission. Unlike antifa.
Talking about putting out antifa-started fires at a church and a school. What a hoodlum!
Explaining that the convicted child molester and mental asylum resident verbally Rosenbaum threatened his life twice that night. The second threat was, "I'm going to cut your f***ing hearts out, n*****s." What a hero! What a loss for society!
Describing the medical aid he rendered to various people that night.
Explains why he was at the Ultimate Gas Station. He had been blocked from getting back to Car Source by a police line, which would not let him through, so he went to the gas station because there were people guarding it. He went there for protection.
Establishes state-of-mind of just seeking safety, not looking to get into a shootout.
Says he got a phone call from someone telling him to come to Car Source lot 3 because antifa was bashing in the car windows and setting them on fire. This is when Rosenbaum ambushed him by jumping out from a position of concealment behind a car and attacked him.
Someone shouted "BURN IN HELL!" at him, to which he responded, "Friendly, friendly, friendly!" to let them know he was not an enemy.
He's sobbing and shaking narrating the part about Rosenbaum attacking him. I could see people who believe he's a "White Supremacist Terrorist" claiming this is fake.
Counsel asks for ten minute break to allow him to regain his composure.
Viva Frei says that crying by defendants tends to not be well greeted by juries. Lawyers say the feeling is, "If you're crying, you're lying." You're putting on a show, or just crying because you got caught.
Rittenhouse is back. Now narrating Rosenbaum charging him and grabbing his gun with both hands.
He's now narrating the mob chasing him, shouting "Get him, kill him!"
