Democrat-Supermajority DC Court of Appeals Sends Flynn Case Back to Spectacularly Biased Sullivan
I think the court has signaled that Sullivan's show trial must end -- they ruled that Flynn hasn't made it "indisputable" that Sullivan is too biased to judge this case, but that's not a ringing endorsement. That sounds like a caution flag.
And they ruled that Flynn still has other remedies for Sullivan's behavior beyond mandamus. Again, that's not blessing Sullivan's scheme to appoint his own prosecutor and conduct his own prosecution. It's claiming that Flynn has other remedies for this that he hasn't yet exhausted. (Exhausting all other remedies is a common requirement when seeking an interlocutory (while the case is still be decided) injunction.)
But will Sullivan heed those warnings, or will this ignorant incompetent miss them?
And what if he does miss them? This court has now announced itself as nothing more than a Democrat Star Chamber. Will they rebuke Sullivan after working so hard to spare him even a mild rebuke?
And by the way: Remember the NeverTrumpers (who are liberal Democrat partisans, straight up, no asterisk) are always dismissing your concerns about partisan judges as "But Muh Judges."
This Is Nothing But a Political Court Now: Viva Frei made these points: 1, Flynn should win on the law. It's not even close. 2, if he loses, it's only due to the court being 8-3 Democrats, with one Republican recusing himself.
He made the further point: If you can predict every single judge's vote based solely on their partisan affiliation -- ignoring the facts of the case -- then what you have is not a court of law, but a court of politics.
This is a court of politics.
