Andrew McCabe, Who Has Absolutely Nothing to Hide Regarding His Actions in the Clinton Email Probe, Demands Immunity in Exchange for Testimony About His Handling of the Clinton Email Probe
He's asking for "use immunity," meaning that his testimony cannot be used to make a case against him.
The trouble is, as I read this, he's seeking immunity from criminal consequence for any statement he makes -- I don't see any exception here for building a perjury case.
Maybe that's implied. I don't know. But there's no point in giving someone immunity for their testimony if that immunity also covers perjury given during the testimony.
Former FBI Deputy Director Andrew McCabe has requested the Senate Judiciary Committee provide him with immunity from prosecution in exchange for testifying at an upcoming congressional hearing focused on how senior officials at the FBI and Justice Department handled the investigation of Hillary Clinton's private email server, according to a letter obtained by CNN.
"Under the terms of such a grant of use immunity, no testimony or other information provided by Mr. McCabe could be used against him in a criminal case," wrote Michael Bromwich, a lawyer for McCabe, to Senate Judiciary Chairman Chuck Grassley, who has requested McCabe testify next week.

"Mr. McCabe is willing to testify, but because of the criminal referral, he must be afforded suitable legal protection," Bromwich wrote to Grassley. "This is a textbook case for granting use immunity. . . . If this Committee is unwilling or unable to obtain such an order, then Mr. McCabe will have to no choice but to invoke his Fifth Amendment privilege against self-incrimination."
McCabe's lawyer claims that McCabe can produce emails that "demonstrate that Mr. McCabe advised former Director Comey, in October 2016, that Mr. McCabe was working with FBI colleagues to correct inaccuracies before certain media stories were published."
Eh, that could be both true and false. He could have given Comey a false and misleading proposal about what he planned to leak or what he did leak, saying he would generally rebut some media claims, without disclosing that he was leaking the contents of a phone call with an Administration official.
Certainly McCabe already provided these emails to the IG -- and the IG concluded they do not prove what McCabe's mouthpiece claim they prove.
Even though I think the IG is probably right that McCabe is simply a perjurer, it would be interesting to see that Comey had once again approved a leak of some kind. I think Comey himself has denied approving any leak in this matter.
