Lindsey Graham: How Can Rosenstein Not Recuse Himself When It Is He Who Wrote the Memo Justifying Comey's Firing?

Remember, it is the firing of Comey which prompted the appointment of the special counsel (allegedly).

Rosenstein wrote the memo opining that Trump had full justification to fire him.

This makes him not just the supervisor of the probe, but a fact-witness in the case.

Sessions recused himself for a far less direct conflict of interest.

How the fuck is Rosenstein still not recused? And why would he not recuse himself?

One gets the sense that, like Peter Strzok, he considers this too IMPORTANT to let anyone else do this important job.

"If you're looking at obstruction of justice misconduct post-presidency, the Comey firing as being a form of obstruction of justice, then Rosenstein is a key witness in that and you can't be a witness and oversee the investigation," Graham told reporters on Tuesday. Graham's comments come after he sent Rosenstein a letter, dated from late last month, questioning his role overseeing the investigation into Russia's election interference and potential collusion between the Trump campaign and Moscow. Graham noted in the letter that it has been "widely reported" that Mueller's probe also includes investigating if President Trump obstructed the Russia investigation by firing Comey. "Do you consider yourself a potential witness in the Mueller investigation regarding the firing of Director Comey by President Trump?" Graham asked in the letter. If the answer is yes, Graham then asked if Rosenstein believes he should step back from the Mueller probe.

And don't forget -- Andrew McCabe suspected Rosenstein of conspiring with Trump in Comey's firing, and even wrote a memo detailing his suspicions, which he then sent to Robert Mueller.

How can Rosenstein oversee an investigation in which a key participant has named himself as a conspirator?
