The Florida man who claimed his girlfriend choked to death during oral sex was found not guilty of second-degree murder Monday.

Richard Patterson, 65, of Margate, was acquitted of killing 60-year-old girlfriend Francisca Marquinez in 2015 after a week-long trial, according to the Sun Sentinel.

During the trial, his lawyers initially argued that Marquinez died accidentally while performing oral sex on him at her apartment.

To bolster their defense, Patterson’s lawyers filed a motion to show his penis to the jury.

I don't believe it's possible to not know you are killing someone during oral sex.

If you read the article, you'll find the judge did not actually permit the defendant to enter his penis into evidence. You'll also find that the dead woman was so decomposed when they examined her they found it difficult to establish the precise cause of death.

Which leads me to question why she was badly decomposed when found. Was her body... hidden?

In any event, medical experts said that it was "unlikely" one could inadvertently kill a woman during oral sex, and the defense actually changed its theory of the case to (and I really don't understand this) that this is how the defendant thought she died.

"That's not the way she died," defense lawyer Ken Padowitz said."“But that’s the way Richard Patterson thought she died."

What? What the hell does this mean? Either she was deliberately strangled or accidentally suffocated by penis. If the latter is impossible, and the defense is admitting that, that only leaves the former possibility, and the defendant's claim of what he "thought" happened seems... entirely self-serving and entirely irrelevant.

And also, preoposterous.

So this guy was acquitted of murder by virtue of having a big penis -- this is some serious Privilege we have to talk about.

But I'm sure all the male readers here will jump to his defense, as I'm certain the men of Ace of Spades are similarly-situated and deal with this heavy, veiney burden as well.
