Soros DA Larry Krasner of Philadelphia Is Brutally Taken Down by (Democrat) Pennsylvania Supreme Court, Which Accuses Him of Bad-Faith and Lying In Order to Set Convicted Murderers Free with No Legal Justification

You've heard of sue-and-settle. That's the unethical and possibly illegal practice of Democrat bureaucrats (and it is almost always Democrats) conceding lawsuits to friendly, politically-aligned litigants. These concessions result in Democrat policy preferences being encoded into law not by regular democratic processes, but by a "consent degree" agreed to by the executive that has the force of law itself.

So if you can't get 50,000 acres of land blocked from development through a law, just get your environmental buddies to sue your department claiming the snail darter is endangered, and then do no oppositional research to verify that. Just agree that yes, the snail darter is endangered and its very very sad, then propose a settlement by which the 50,000 acres you wanted to put off-limits for development but could not get legislatures to agree to are now off-limits for devolopment per the terms of a consent decree you sign with the "hostile" litigants you actually conspired with to bring about this outcome.

It's an inside-outside game, except that both parties are actually insiders, conspiring with each other to defraud the public.

Such as Larry Krasner, the pro-crime, pro-murder Soros-funded DA for Philadelphia.

For years, he has been setting murderers free or granting them new trials -- which they'll probably win, because witnesses die and evidence is destroyed over the course of 10-20 years -- by claiming that the defense lawyers he's conspiring with brought forward new evidence sufficient to overturn past jury verdicts.

This is the kind of scheme that is almost never punished. How would you prove it? And who would be the party to complain? If you try to sue Kramer himself, a leftwing judge will probably just say you lack "standing" to sue him.

Well, amazingly, the Democrat-majority Pennsylvania Supreme Court just called him out and didn't use polite or evasive language to explain why they refusing his latest "concession" to a defense lawyer to let a murderer out of jail. They say, pretty much straight-up, "You're lying, there is no evidence sufficient to compel this, these are bad-faith 'concessions' you're making to your political allies, and you're setting murderers free not because the evidence warrants it but because you have a personal, political interest in setting murderers free."

Not only do they set aside his lawless decision to free a murderer, but they go a big step further and say because you are a bad-faith actor without credibility, all future decisions "conceding" a point to defense lawyers about a prior jury verdict will first have to be approved by the state Attorney General. They're taking his License to Free Murderers away from him.

Wild stuff. Philadelphia District Attorney Larry Krasner in hot water and now needs the PA AG's office to review all attempts to overturn a murder conviction.

"In a forceful and scolding opinion, the Pennsylvania Supreme Court ruled Tuesday that District Attorney Larry Krasner's office misled the courts, "violated its duty of candor," and submitted false statements when asking a judge to vacate a 2004 murder conviction.

Justice Kevin Dougherty wrote that prosecutors' pattern of misleading judges in seeking to overturn murder convictions is so troubling and recurrent that, going forward, before Krasner's office seeks such relief, judges must notify the state attorney general's office and allow it to review the case."

DA Krasner's Office was playing fast and loose when it came to trying to overturn murder convictions... and then not doing anything after overturning them.

Time and again it has come out that his DAOs lied to the court, hid evidence, or didn't communicate with the families of the victims.

This isn't political. The PA Supreme Court is 5-2 Democrat. This is about due process and justice.

Crazy that it has been able to go on for this long without somebody stepping in...

"The attorney general's office had filed an amicus brief in support of the families, arguing that, since 2018, Krasner's office had conceded relief to the defendants in 115 cases in which there was no "adversarial testing" of the case.

Attorney General David Sunday, a Republican, said in a statement Tuesday that his office is grateful to serve "as a check on this process for the citizens of Philadelphia and ensure that the interests of victims' families are represented."

When an investigation reveals that a defendant was wrongfully convicted, his office said, prosecutors have a duty to remedy the situation -- through the established court processes.

"As the Court noted," his office said, "this case is about the failure of the process in Philadelphia, both as to this defendant and many others.""

The opinion explains that while the Post-Conviction Relief Act (PCRA court) is the actual body that sets murderers free, they have, until now, taken the DA's "concessions" that prior verdicts must be overturned as nigh-dispositive. Krasner would just concede case after case to his political allies seeking to free murderers.

Now they say that Krasner will not be allowed to make these "concessions" on his own authority -- he'll have to submit them to the state AG for review and approval.

They straight-up say that Krasner is ignoring the law in favor of his own personal lunatic need to set murderers free:

"When relief is not dictated by the record and law but merely advocated for personal, political, ideological, policy, or other non-legal reasons, a prosecutor's concession does not minister justice; it facilitates injustic."

In an extraordinary ruling from Pennsylvania's Supreme Court, if the Philadelphia District Attorney's Office wants to overturn a conviction in state court, the state Attorney General's Office must be given the chance to review the case and make sure a proper investigation was done.

The order comes as a King's Bench petition, which is basically a mechanism for the high court to take over a case and review it. The case at hand involved Lavar Brown, a man convicted of killing two men in the early 2000s and sentenced to death row.

In their opinion, the five Democratic and two Republican justices said District Attorney Larry Krasner has "numerous instances of untrustworthy concessions, lack of candor, misrepresentations of fact, lack of adequate investigation, and avoidance of hearings" and is "unreliable."

They said when a district attorney fails to follow through on their duties it "does not minister justice, it facilitates injustice."

The high court said because "the problems are poised to continue," it's now requiring the Attorney General to intervene on behalf of the commonwealth.

"It is only in Philadelphia County that there has been a pronounced, documented pattern of highly problematic prosecutorial concessions," the judges added.
