Politico: Lawless Lowly District Court Political Hacks "Believe They've Found a Way to Bypass" the Controlling Rulings from the Appeals Court That Serves as Their Superior Court, and That's Great

Politico is very excited that lowly district court judges may have found a way to "bypass" the rulings of the Fifth Circuit court of appeals, a court which is superior to them and which makes the controlling law in their district.

But they'll just figure out a way to ignore their judicial superiors.

Note that yesterday, Politico was scandalized by left-wing judges complaining to them that the Trump Administration slow-walks and subverts their orders.

It's just terrible! We can't have a country in which the duly-elected president and head of the entire executive branch disregards the orders of lowly, one-of-677 district judges!

Courts across the country have overwhelmingly rejected the Trump administration's effort to round up thousands of immigrants and lock them up without a chance for bond -- even if they have no criminal records and have lived in the United States for years.

But the Trump administration has slow-walked or outright defied judges' orders demanding the release of people scooped up by Immigration and Customs Enforcement at an increasingly rapid clip.

But now, the lowly district court judges are scheming about how to ignore their direct judicial superiors, their "commander ranked" superior officer judges, and Politico thinks that's very clever and nifty!



Judges may have found a way to bypass 5th Circuit ruling upholding Trump's mass detention policy

Two Texas judges, who are bound by the circuit's ruling, outlined a legal rationale allowing them to continue granting immigrants' release.

Federal judges may have found a workaround to reject the Trump administration's mass detention policy after an appeals court backed the approach.

A three-judge panel of the 5th Circuit Court of Appeals on Friday blessed the administration's interpretation of the government's power to systematically detain people targeted for deportation -- even if they have no criminal records and have lived in the country for decades.

But two federal district court judges in Texas, who are bound by the New Orleans-based 5th Circuit's ruling, said the 2-1 decision left an opening for them to continue granting immigrants' release on other grounds, primarily constitutional arguments against detaining people who have established roots in the U.S. without due process. Those roots amount, in legal parlance, to a "liberty interest" that the Constitution says cannot be taken away without at least a hearing before a neutral judge.

This is an entirely made-up bit of judicial wishcasting that they're creating just to keep giving the same illegal aliens, all eligible for deportation, more and more "bites at the apple." They will keep spinning out novel, fantastical, made-up new theories so that the illegal aliens are perpetually "in the system" awaiting their next hearing.

They're contriving a way to keep illegals in the country forever, because they'll just keep making up new theories to sue under, and thus will keep them in the country, always with the next appeal filed for the next judge, until they die.

"This conclusion is not changed by the Fifth Circuit's recent decision," Judge Kathleen Cardone, an El Paso based appointee of George W. Bush, ruled late Monday in at least five cases, concluding that the circuit's decision "has no bearing on this Court's determination of whether [the petitioner] is being detained in violation of his constitutional right to procedural due process."

Judge David Briones, an El Paso-based Clinton appointee, reached a similar conclusion.

"The Court reiterates its original holding that noncitizens who have 'established connections' in the United States by virtue of living in the country for a substantial period acquire a liberty interest in being free from government detention without due process of law," Briones wrote.

The decisions from the Texas-based judges are notable in part because the administration has often rushed detainees there after their arrests in other states such as Minnesota.

By the way, the exact same "reporter," Kyle Cheney, is responsible for both of these "news" accounts, one assailing the DOJ for questioning the rulings of judges, the other celebrating district court justices spamming out new fictional "rights" in order to evade the ruling of the higher Fifth Circuit Court of Appeals.
