DOJ Settles $30 Million Wrongful Death Lawsuit by Ashli Babbitt's Family

The Department of Justice and the estate of Ashli Babbitt have reached a preliminary settlement in a $30 million wrongful death lawsuit tied to her fatal shooting during the January 6, 2021 Capitol riot. Babbitt, an unarmed Air Force veteran and staunch Trump supporter, was shot by a Capitol Police officer as she attempted to breach the Speaker's Lobby.

DOJ and Babbitt's estate reached a settlement "in principle" in the $30 million lawsuit filed in 2024.
Babbitt was shot by Capitol Police Lt. Michael Byrd while trying to climb through a barricaded door during the January 6 riot.

Babbitt's political views had drawn attention prior to her death. A vocal supporter of then-President Donald Trump, she frequently posted on social media in support of the president and occasionally shared content linked to the QAnon movement. Her death has since become a rallying cry for Trump supporters, many of whom view her as a martyr unjustly killed by a system increasingly weaponized against political dissent.
Earlier this year, President Trump signaled his continued concern over the treatment of January 6 defendants and raised the possibility of financial redress for those imprisoned, including a reexamination of Babbitt's case. "We're going to look into it," Trump said in March when asked whether justice had been served in Babbitt's death.
