Emmet Sullivan, the Judge Who Embarked on His Own Prosecution of Michael Flynn After the Government Dropped Its Charges, Issues a Halt to Title 42 Deportations
Emmet Sullivan is a stupid old man aging poorly who is now retired but, like many old, decrepit judges, continuing to make bad law as a semi-active "reserve judge."
They should be forced to take cognitive tests every year.
His behavior during the Flynn case, in which he made himself, a judge, the illegal prosecutor of a man, was unprecedented, inexcusable, and shocking.
And now this partisan bastard with creeping senility has decided that the law is unconstitutional because he says it is.
Title 42, if you recall, is part of the US code that grants emergency power to expeditiously remove illegal aliens during a public health emergency. Trump invoked this long-existing law during covid. Biden suspended it, but has recently been using it again to deport Venezuelans to Mexico, when they began threatening his political prospectes.
Sullivan has decided, on his own senile authority, that it must end now. Or, after Biden asked for reprieve: In five weeks, on December 21.
A federal judge on Wednesday put on hold for five weeks his ruling striking down the controversial Title 42 immigration policy, a Trump-era rule that's allowed US authorities to expel more than 1 million migrants who crossed the US-Mexico border.
US District Judge Emmet Sullivan said in the new order that he was granting the Biden administration's request for a stay with "GREAT RELUCTANCE."
The ruling striking down Title 42 will be now on hold until midnight December 21.
Sullivan's ruling on Tuesday will leave the Biden administration without one of the key tools it had deployed to address the thousands of migrants arriving at the border on a daily basis and could restore access to asylum for arriving migrants.
The authority -- which was heavily criticized by public health experts and immigrant advocates -- had largely barred asylum at the US-Mexico border, marking an unprecedented departure from traditional protocol. Its end could now restore access to asylum for arriving migrants, allowing them to enter the US and make their case in immigration court.
Sullivan had found the Title 42 order to be "arbitrary and capricious in violation of the Administrative Procedure Act."
Prior to Title 42, all migrants arrested at the border were processed under immigration law. Thousands of migrants sent back to Mexico have been waiting along the border in shelters. Officials have previously raised concerns about what the end of Title 42 may portend, given limited resources and a high number of people trying to enter the country.
Why are retired judges allowed to rule on major cases? If we have to suffer them at all, why aren't they restricted to ruling on matters of lesser concern? Like what flavor of tapioca the assisted living group home will serve on Thursdays?
And why is this nasty piece of work even allowed in a courtroom without facing a battery of tests from a geriatric neurologist first?
