New York Court Rules Vaccine Mandate "Capricious, Arbitrary" and Unconstitional

The State Supreme Court in New York is actually the lowest level of court of general competency (that is, ability to hear all cases). What we'd think of as the "Supreme Court" is the Court of Appeals of New York.

Still, this is good.

The Court finds that the New York City Board of Health's rules that some people must be vaccinated, whereas other people do not have to be vaccinated, is "capricious and arbitrary."

Athletes, for example, don't have to be vaccinated. This is obviously not due to The Science (TM), but due to pressure from league owners and fans who would not want to lose games because unvaccinated athletes were ordered to be fired by the state.

The court also found that Board of Health violated separation of powers by essentially acting as an unelected legislature in making up these capricious and arbitrary rules.
