Jury Finds Kim Potter Guilty of Manslaughter In Completely-Accidental Death of Duante Wright

I guess we're just sacrificing people to the mob now.

If you don't remember, Kim Potter was the cop who thought she was pulling her taser to stop a fleeing suspect, but accidentally pulled her gun. It was obvious she meant to pull the taser -- she shouted "Taser!" as she drew her gun.

As she did not believe she was pulling a deadly weapon, she couldn't have the culpable mental state for first-degree manslaughter, which requires "intentionally causing the death of another." You can't intend to cause the death of someone with a non-lethal weapon.

I don't think she should have been convicted of second-degree manslaughter, either: "by the person's culpable negligence whereby the person creates an unreasonable risk, and consciously takes chances of causing death or great bodily harm to another"

Note there she would have had to consciously taken a risk. She did not. Consciously, she believed, wrongly, she was using a non-lethal weapon. She did not think she was taking a risk.


Yes, she was wrong. But being wrong means she did not have intent. Or "conscious" intent to take a risk with someone's life.

Update: I guess she was found guilty under this section of the first-degree manslaughter statute:

(2) violates section 609.224 and causes the death of another or causes the death of another in committing or attempting to commit a misdemeanor or gross misdemeanor offense with such force and violence that death of or great bodily harm to any person was reasonably foreseeable, and murder in the first or second degree was not committed thereby;

The section referenced is about committing a fifth-degree misdemeanor battery.

A cop using a taser (which is what she believed she was using) against a fleeing violent felon with an arrest record a mile long is an actual crime now, which gives rise to a manslaughter charge based on that crime?

So the jury feels that using a taser against a suspect fleeing in a car constitutes an illegal battery, and then, on top of that, using a taser against that person (which is what Potter thought she was using) constitutes the use of force where "death or great bodily harm was reasonably foreseeable?"

No, this was a compromise verdict. This was a "Please don't burn down our cities again, BLM" verdict.


There's also criminally negligent homicide but apparently the jury compromised and convicted her of something she couldn't be convicted of.

Minnesota is so traumatized by weekly BLM riots and arson so we're just lynching people by trial now.

By the way, the judge here has been subject to stalking and threats from a BLM-aligned thug.

A Black Lives Matter activist has been arrested and charged with trying to intimidate the judge presiding over the manslaughter trial of former Brooklyn Center Police Officer Kim Potter.

The incident occurred on Nov. 6 when 32-year-old Cortez Rice livestreamed himself inside a Loring Park condo building where he said he believed Hennepin County District Court Judge Regina Chu lived, the Minneapolis Star Tribune reported.

Activists were angry that Chu had banned cameras from the courtroom for Potter's manslaughter trial in the death of 20-year-old Daunte Wright.
