After Biden Announces He Will Keep an Obviously-Unconstitutional Imposition of Communism In Place by Filing Bad Faith Appeals, NeverTrump and Conservative, Inc., Who Supported Biden, Pretend to Be Surprised

As covered yesterday, this demented Alzheimer's patient is saying the quiet part out loud, and alerting the Court that he is acting in bad faith and tends to use its procedures against it to do something he concedes is "probably" illegal.


As Jonathan Turley wrote of his first admission of intent to act unconstitutionally and in bad-faith:

The President said the quiet part out loud and admitted that they would use litigation as a delaying tactic to spend money without constitutional authority. That line will now likely be repeated at the top of any motion challenging the extension and seeking a temporary injunction.

President Biden's position not only dismisses constitutional protections but disregards his own presidential obligations.

It was just six months ago that President Biden swore to the following words:

"I do solemnly swear that I will faithfully execute the Office of President of the United States, and will to the best of my ability, preserve, protect and defend the Constitution of the United States."

Chief Justice Roberts did not include an option for unconstitutional acts in the name of a good cause or when convenient. Biden agreed to uphold the Constitution to the best of his abilities.

The Supreme Court has made clear that the extension would be unconstitutional as was the original moratorium. Biden asked the CDC to use the very same authority in extending the moratorium to give him a pretense for the spending of federal money. That does not seem to bother many legal experts. After all, this unconstitutional act would be done for a good cause. Yet, imagine if a Republican president announced that he was told that an order on drilling or subsidizing a religious organization was unconstitutional but would use litigation to get the money out before a court could intervene. The hue and cry in the media and from law schools would be deafening.

Biden came to office declaring a return to the "rule of law" but has actually racked up an impressive array of court losses. Now he is treating a presumptively unconstitutional act as a purely tactical consideration to allow the spending of federal funds. That is not exactly what he pledged before he declared "so help me God" on January 20th.

The Court should act with alacrity to thwart an announced, plotted scheme to subvert the Constitution of the United States. You know, the one it is sworn to uphold, and the one the Oath of Office of the President of the United States promise to uphold.

The Oath that the Chief Justice of the Supreme Court administers, by the way.

But will the Court? Will jelly-spined Likely Sexual Assaulter Brett Kavanaugh actually check the Biden Administration's brazen, declared and trumpeted lawlessness?



Meanwhile, NeverTrump and Conservative, Inc., who went all-in on supporting Biden as Ruling Class coup against a president elected without their permission by people outside the Ruling Class, now feigns shock and outrage.

Strangely, they were pretty cool with Biden just seven months ago!

I do love all of them saying "Biden should be opposed" when they had their chance to oppose Biden in all of 2020 and decided instead to support him.

But now they're all shocked, shocked that Biden isn't the "moderate norms-restoring centrist" they promised us.

Right?

Right.

Here's NeverTrump Serial Voucher and Establishment Shill and Confirmed Government-Lover Andy McCarthy expressing his Shock and also his Chagrin that Joe Biden has turned out not to be a Norms Restorer but actually a wilful violator of the Constitution.

Specifically, and in blatant violation of his solemn duty to execute the laws faithfully, Biden has usurped Congress’s legislative authority and declared the power to legislate. He is running roughshod over the separation of powers, which is the foundation of our constitutional framework, limiting power and preserving liberty.

If only you and National Review could have done something to stop this utterly-unpredictable turn of events!

Slow Joe's old boss Barack Obama similarly discovered an unconstitutional power to make law by Kingly Decree when he felt he wanted to (and when the progressive wing of his party was demanding DACA).

How could the Mensa Chapter Presidents at National Review possibly have predicted that the norm that Joe Biden would be most interested in restoring would be Barack Obama's occasional assertion of Divine Right?

In fact, scanning the headlines at National Review, all of the Conservative, Inc. crew is Shocked and Chagrined that the candidate they supported for president turns out to be... well, the third term of Obama that everyone except them knew it would be.

Let's definitely listen to this Brain Trust of layabouts and check-collectors some more!

Don't give them any credit for realizing this too late; even the firebreathing Democrat partisans at the Washington Post condemn this as contempt of the Constitution:

If the Trump administration had ignored a direct warning from the Supreme Court, Democrats would rightfully line up to condemn the president. Mr. Biden does not get a pass on the rule of law because his heart is in the right place.
