The Morning Report - 12/15/20 [J.J. Sefton]

Good morning, kids. Tuesday and while hope always springs eternal, I'd be lying to you if I said the glimmer wasn't getting fainter by the hour. On the depressing side, the Electoral College voted yesterday to give Polident-elect Biden the "win" with 306 electoral votes, oddly enough the same margin that President Trump defeated Clinton by four years ago. That said, Republicans from the six states where the smash-and-grab occurred on election night plus New Mexico did vote for an alternate slate of Trump-committed electors on a procedural basis in order to keep the investigations into the fraud going and presumably be recognized in Congress should those investigations actually bear fruit.

Andrea Widburg at American Thinker seemed to me to be cautiously upbeat.

Monday was the day when the states designated their electors to cast the states' votes for president. By day's end, creepy, confused Joe Biden had 306 electoral votes.

Democrats are ecstatic, believing that they now have a signed, sealed, and delivered White House. They don't.

The Supreme Court currently appears to be a craven institution. Many think the Court is sending a message saying that, if Democrat Senate candidates win in Georgia, giving both the White House and Congress to the Democrats, it will rubber-stamp everything the Democrats do. In this way, the justices hope to prevent court-packing that will diminish their prestige and cachet. Still, we might yet be surprised. Additionally, more evidence keeps emerging about massive fraud...

... The Director of National Intelligence, John Ratcliffe, will be issuing his report on December 18. If there really is provable massive fraud or foreign interference, the election cannot stand...

... According to Reuters, if states select different slates of electors, the House and the Senate can simply ignore one of those slates. However, if the House and the Senate select different slates from those states, it's entirely unclear what happens next, especially since the Electoral Count Act (which cannot trump the constitution) is muddled:

Academics have sketched out several scenarios. Under one, Pence as president of the Senate could throw out both sets of a state's electors. Another contemplates that the House of Representatives would end up choosing between Biden and Trump. [This scenario would give one vote to each state and since the Republicans have more states with Republican majorities, President Trump would likely be the winner]. There is even a scenario in which the Speaker of the House, currently Democrat Nancy Pelosi, could become acting president.

My one quibble with the estimable Ms. Widburg (and others in the links) would be her analysis about SCOTUS refusing to take the case for fear of the Democrats packing the courts as retaliation should they manage to steal the two Georgia Senate seats in next month's runoff. If anyone doubts that that is exactly what they will do - steal the runoff and pack the court - I have a couple of bridges over the East River to sell, cheap. Then again, with Roberts, Gorusuch, Kavanaugh and most disappointingly Barrett not stepping up to the plate and hearing the Texas lawsuit, court-packing may be unnecessary. But it is a handy cudgel if/when issues of gun rights, free speech, religion, and of course abortion cases reach the court in the coming years. Meh, call it an "insurance policy." Nudge-nudge wink-wink. But I digress.

So, from where I sit, the end game in all of this looks to be Congress. While the Senate, with proven stooges in the Enemy camp such as Romney, Collins, Murkowski and a few others, itching to stab Trump and America in the face is dubious at best, the House is much more reliably pro-Trump. And even at that, we are still dealing with the GOP as well as threats of physical violence underscored not only by BLM-tifa, but by the actions of James Hodgkinson and others. Still, the 30-20 GOP edge in state delegations means, in the best of all possible scenarios, that should it get to that point, Trump would ultimately prevail. But getting to that point is firmly in Hail Mary territory.

Look, the evidence, both circumstantial and now provable with the Dominion machines in Antrim County, MI, as well as eyewitness accounts and the actions on election night of those counting the votes is both incontestable and massive. In that light, it is absolutely maddening that the GOP state legislators who are at the local level and well acquainted with the utter criminality and corruption of their counterparts in the Enemy camp, did not do their duty in first refusing to certify their elections or awarding their electors to Trump. But in deciding to seat two sets of electors, whether out of fear, fecklessness or both, they did at least keep the issue alive, albeit by passing the buck elsewhere.

So now all eyes are on DNI Ratcliffe and what he will announce come Friday, or perhaps before that, as well as Trump vis a vis his executive order from 2018 regarding foreign interference in our elections:

Section 1. (a) Not later than 45 days after the conclusion of a United States election, the Director of National Intelligence, in consultation with the heads of any other appropriate executive departments and agencies (agencies), shall conduct an assessment of any information indicating that a foreign government, or any person acting as an agent of or on behalf of a foreign government, has acted with the intent or purpose of interfering in that election. The assessment shall identify, to the maximum extent ascertainable, the nature of any foreign interference and any methods employed to execute it, the persons involved, and the foreign government or governments that authorized, directed, sponsored, or supported it. The Director of National Intelligence shall deliver this assessment and appropriate supporting information to the President, the Secretary of State, the Secretary of the Treasury, the Secretary of Defense, the Attorney General, and the Secretary of Homeland Security.

(b) Within 45 days of receiving the assessment and information described in section 1(a) of this order, the Attorney General and the Secretary of Homeland Security, in consultation with the heads of any other appropriate agencies and, as appropriate, State and local officials, shall deliver to the President, the Secretary of State, the Secretary of the Treasury, and the Secretary of Defense a report evaluating, with respect to the United States election that is the subject of the assessment described in section 1(a):

My reading of Ratcliffe is that he has proven himself to be an ally of the President, so I think his report is going to reflect the truth about Dominion, and all the other bad actors, foreign and domestic, associated with them. As for Trump, he not only has the stones to pull the trigger on this, he really has no alternative. Ultimately though, it's still out of his hands and he is going to have to rely on people who may be frightened, corrupt or lacking the character to uphold their oaths to protect the Constitution and the people, in a situation that is beyond anything experienced since the Civil War, if ever. To put it mildly, that is a big ask. If you're praying, pray to the Almighty to give these people the wisdom and the courage to do what's right.
