The Morning Report - 10/27/20

Good morning, kids. Tuesday and it's a beautiful morning. Amy Coney Barrett was sworn in last night after being confirmed by a Harry Reid simple majority in the Senate. The swearing in of Justice Barrett to take the empty seat on the Supreme Court is filled with a number of metaphors as well as at least one deliciously ironic coincidence; yesterday was Hillary Clinton's birthday. Just over four years ago, the now deceased predecessor of Justice Barrett, who was no spring chicken even then and a double cancer survivor was urged to step down so that Barack Obama could appoint her successor, one who would be equally anti-Constitutional. But no. She was determined to bitterly cling to that seat so that she could live to see her successor sworn in by Hillary, who was after all, a 100% lead pipe cinch to be the first female president (the jury is still out as to whether or not that was, in fact, Obama or James Buchanan). If you're reading this post wherever you are, how did that work out for you?

The second metaphor, and a powerful one at that, was that a black man did the honors of swearing in a woman. Yet to the left Clarence Thomas is not black and Amy Coney Barrett is not a woman. Both of them are infidels and apostates to Leftism, which to them trumps biology. As I had mentioned, Justice Barrett is the antithesis of everything her predecessor was and what the Judiciary had been corrupted by the Left to be: a supra-legislative body the sole purpose of which was to advance laws and policies that could never survive the ballot box or Congress. In her speech last night, this demure, attractive lady, in her own quiet and elegant way, leaned back and cold-cocked the Democrats right in their collective pie-hole:

The confirmation process has made ever-clearer to me one of the fundamental differences between the federal judiciary and the United States Senate, and perhaps the most acute is the role of policy preferences. It is the job of a senator to pursue her policy preferences; in fact, it would be a dereliction of duty to put policy goals aside.

By contrast, it is the job of a judge to resist her policy preferences. It would be a dereliction of duty for her to give in to them. Federal judges don't stand for election, thus they have no basis for claiming that their preferences reflect those of the people. This separation of duty from political preference is what makes the judiciary distinct among the three branches of government. A judge declares independence not only from Congress and the president, but also from the private beliefs that might otherwise move her. The judicial oath captures the essence of the judicial duty; the rule of law must always control...

...The oath that I have solemnly taken tonight means at its core that I will do my job without any fear or favor and that I will do so independent of both the political branches and my own preferences. I love the Constitution and the democratic republic that it establishes, and I will devote myself to preserving it.

This should not be controversial. The fact that it is controversial speaks to just how corrupted and diseased our government and politics have become over the course of the past 50 years or even longer. If that doesn't convince you, then the shrill, bitter, poison words out of the filthy sewers of the Democrats in opposing this confirmation speak as loudly as a gaggle of five-year-olds on a sugar bender shrieking and kicking after being told "no."

A little reminder about judicial philosophy for our Leftist chums. The Constitution is no more a living and breathing thing as is a brick. Words have meaning and the words in our governing documents are not poetry, not from the Kabballa, or "E Pleb Neesta." They are clear, unambiguous and we have volumes of correspondence from the men who wrote it as to what they meant in their work. The Constitution is not fungible and subject to changing times, tastes or technology. It is the gold standard by which laws and regulations must meet or else be struck down. They are the rules that protect the individual rights against something else that does not change: human nature, i.e. the will to power of some who seek to lord over and enslave others. This idea that the court must be "balanced" is madness. The only people who should be on that court are justices who approach their responsibilities exactly as Justice Barrett has stated. The fact that Ruth Bader-Ginsburg and perhaps a dozen or so others who thought and acted like her over the course of the past 231 years were allowed within 10 miles of that bench is a travesty.

So now, aside from lashing out at President Trump and the GOP for following the rules and doing their duty as well as playing totally kosher hardball politics thanks to Harry Reid who in the waning days of the Obama reign of error disregarded precedent and comity for what he thought would be political advantage, the Democrats are shrieking about "fairness" and packing the courts if they have the chance. Being a sore loser is of course childish in the extreme. And their claiming the mantle of righteousness and morality as is their wont is sickening. But these people are not children. The next time they have the chance, they will burn the country down and us with it.

Yes, Mairzy-Doats Hirohito is a sub-literate degenerate daughter of a child pimp. While her antics did debase an otherwise solemn and beautiful ceremony, it's Chris Coons who is out of his friggin' mind.

"[W]e've got to have a wide-open conversation about how do we rebalance our courts. Yes, the two Supreme Court [seats] that have been stolen through these processes that are just wildly hypocritical have been used to jam through partisan nominees. But we've got to look at our federal courts as a whole, Rachel. Because we've seen hundreds of conservative judges put on circuit courts and district courts all over this country in the last four years, in many cases, too young, too unqualified, and too far right to be allowed to sit peaceably without our re-examining the process, the results, and the consequences."

Is it just me or did this diseased little mouse testicle just declare open season on judges? I get it; you're angry and lashing out because thanks to the greatest American president in the last 100 years is actually hell bent on reversing the trajectory of this nation during that time frame and doing everything he can to return power where it belongs; to the individual citizen. But this is so manifestly irresponsible that it borders on the criminal. How many James Hodgkinsons are out there with Chris Coons' office on speed dial? Or cupcakes like the "far right" would-be terrorist armed to the teeth and plotting to kill Goofy Joey Biden, who turns out to be a far-left Islam-curious Bernie Bro? Coons and his cohorts have encouraged the Burning-Looting-Murdering of our cities to take down this President and punish this country. A few bullet-ridden judges is how they make the omelet.

Disgusting.

More cases means more testing and likely more false positives. It still does not translate into death; the mortality rate is still statistically on par with flu.
- Goofy Joey can't keep his facts straight on student loans.
