There was an interesting case out of the Second Circuit about how long the government may retain seized computer files. I'm not sure it's correct, but that's the beauty of modern Fourth Amendment jurisprudence: it's such a mess, with exceptions to the exceptions to the exceptions to the general rules, that even an expert like Orin Kerr is playing guessing games. "I'll have to think more about this, but at least my initial reaction is that the court’s basic approach makes some Fourth Amendment sense."
Even my liberal lunch buddy is questioning the timing of the Abu Khattalla capture. Only 37% of Americans still support Obama on foreign policy. That's an all time low.
