DoD Pulls the Plug on Holdout Gitmo Tribunal
Last week, a military judge denied the President's request to suspend proceedings against Abd al-Rahim al-Nashiri, the guy who planned the USS Cole attack. The judge was the only one to refuse to grant Obama's motion. To comply with his executive order to put a halt to the military commissions, the Pentagon has withdrawn the charges against al-Nashiri. He was to be arraigned on Monday.
That arraignment would have been the point of no return for purposes of double jeopardy. The Pentagon and the White House insist that they can refile the charges at any time and will as soon as they figure out how they want to proceed. In the meantime, al-Nashiri drops back into legal limbo.
The President will meet with the family of Cole and 9/11 victims tomorrow afternoon to explain himself.
