THE MORNING RANT: The Awful Precedent of the Clancy Trial’s Juror-Harassment

A terrifying precedent was set in the Lindsay Clancy trial, as Boston media outlets engaged in a multi-prong hit job on the lone juror who refused to acquit Mrs. Clancy for the murder of her children.

Going forward, any juror who remains true to his conscience and doesn’t submit to the mob knows that the media may dox him. Every negative event in his life could be exposed, and the media has now shown that it will provide identifying information to activists who wish to harass or harm a “wrongthink” juror.

The media has normalized putting jurors themselves on trial if they don’t issue the “correct” verdict.

Can you imaging being a juror in a trial involving a drug cartel? With the Clancy precedent, any juror who convicts a cartel member can have his life and address exposed for convicting a “migrant dreamer” who got a little sideways with the law.

Boston Herald Opinion columnist Wendy Murphy started an editorial with these chilling words: “Now that the holdout juror in the Lindsay Clancy case is getting the negative attention he deserves…”

”…the negative attention he deserves…” spoken about a juror by a mainstream media outlet is a terrifying thing to read. These are the words you’d expect from a foot soldier for the likes of Mao or Stalin.

Meanwhile, Ryan Kath of “NBC 10” in Boston decided to dig up and publicize criminal “allegations” against the juror, even though there was not an actual criminal record. Mr. Kath also reported on family gossip regarding the juror, and Kath even found it newsworthy that the targeted juror was late in making rent payments. This is juror intimidation, and the message is clear about the punishment that awaits future jurors who won’t betray their conscience to reach the media’s preferred verdict.

The NBC10 Boston Investigators are uncovering new details about the lone holdout juror from the Lindsay Clancy murder trial. Court documents and interviews with family members reveal a history of domestic violence allegations. We discovered a pending eviction case tied to months of not paying rent.

Suffice it to say, NBC 10 Boston did not investigate any criminal allegations or financial delinquency of the jurors who voted “correctly.” Message received. The privacy and anonymity of the jury room has been invaded by the hostile media.

As a young man several decades back, I was on a jury in which we found the defendant guilty of aggravated manslaughter. He and his partner were shoplifting goods for a fencing ring, and when a security guard pursued them into the parking lot and tried to block their panel van from getting away, the defendant (who was driving) ran the security guard over, killing him. (The other shoplifter pleaded out to a lesser charge.) Knowing that the defendant who I sent to jail was part of a larger criminal ring, I was a little concerned for my safety if my name were to be released. The judge assured us jurors that our anonymity would be protected, and the media back in the day respected it. That is clearly not the case any longer.

Jury duty is a necessary act of citizenship – one that too many good people try to avoid. But if honorable people who don’t want the worst day of their lives exposed by the media are made to fear serving on a jury, fair trials will be a thing of the past.

While it is against the law in most states to threaten, intimidate or harass jurors, it is generally not specifically illegal to disclose their names. Therefore, it is effectively legal for the media to dox jurors so that their political allies can inflict street punishment. The next time a Daniel Penny or Kyle Rittenhouse is railroaded into a murder trial, we can expect the full force of the national media to intimidate any juror who won’t convict.

This has to stop. Jurors must not fear retribution for being the target of media opprobrium. Red states need to codify that it is illegal for the media to reveal jurors names and personal information, and if we ever get a Republican Congress that is capable of actually passing laws, it too should pass legislation on a national basis to protect jurors from media doxxing.
