DHS: An Ignored 1996 Clinton-Era Law Says That States Have to Report the Number of Illegals Receiving Federal Benefits Like SNAP. We're Going to Start Enforcing It Now.

The law was passed insincerely, I imagine, with both Clinton and corporate-owned fake "conservatives" pretending they didn't want to take American's tax payments and deliver them to foreign criminals.

But insincerely or not, political ploy or not, they passed it. There is no "We only passed this to con the rubes" exception to federal legislation. Look it up. I didn't, but I assume there's not one.

Finally, someone is going to actually enforce it.

States now must report undocumented immigrants to DHS or risk federal funding, DOJ says


* All states going forward must report undocumented immigrants known to be in a state to the U.S. Department of Homeland Security or risk losing federal funding for programs meant to aid low-income individuals, the Department of Justice said in a new legal opinion.

* The DOJ, in issuing the opinion, revised the Office of Legal Counsel's prior opinion from 1998, which found that only specific state agencies that administered the Temporary Assistance for Needy Families and the Supplemental Security Income programs needed to provide information to federal immigration authorities.

* "When a state chooses to participate in TANF, it accepts the obligation to report illegal aliens in the United States," Assistant Attorney General T. Elliot Gaiser said. "Tax dollars intended to help vulnerable Americans should not perversely encourage illegal entry into the United States, but rather should reinforce our laws and our borders."

The DOJ, in issuing the opinion, revised the Office of Legal Counsel's prior opinion from 1998, which found that only specific state agencies that administered the Temporary Assistance for Needy Families and the Supplemental Security Income programs needed to provide information to federal immigration authorities.

"Congress wrote this requirement plainly," Assistant Attorney General T. Elliot Gaiser of the DOJ's Office of Legal Counsel, said in a statement.

"When a state chooses to participate in TANF, it accepts the obligation to report illegal aliens in the United States," Gaiser said. "Tax dollars intended to help vulnerable Americans should not perversely encourage illegal entry into the United States, but rather should reinforce our laws and our borders."

The DOJ in a statement Wednesday said the Office of Legal Counsel's Sept. 1 opinion "explains that Congress defined 'State' broadly in the Personal Responsibility and Work Opportunity Reconciliation Act of 1996."

"As a result, when a state accepts federal TANF or SSI funds, the entire state government -- including all component agencies -- is bound by federal law to share information with DHS about individuals the state knows to be not lawfully present," the DOJ said.

The new opinion only applies proactively, not to past enrollments in TANF and SSI.

All 50 states, the District of Columbia and several U.S. territories participate in both programs. Federal TANF funding grants top $16.4 billion annually, according to the DOJ.

California AG Rob Bonta says he will not comply with the law because Trump is changing the law by following the wording of the law.

As The Federalist reported, the Clinton administration took numerous actions to pave the way for illegal aliens to come into the country, especially those who offer nothing to American society and were virtually guaranteed to leech off the welfare system.

That included trashing the "public charge" rule that had governed American immigration law for at least 100 years, which said that an immigrant should not be admitted into the country if he was unlikely to be able to take care of himself without government assistance.

Now it is estimated that 59 percent of illegal immigrant households are on at least one welfare program, and 52 percent of legal immigrant households are in the same position. Meanwhile, 39 percent of native-born Americans use at least one welfare program, which is still an enormous amount, but the fact remains that the programs are for Americans, not foreigners.

California accounted for more than 80% of all federal welfare cash assistance provided to households headed by illegal immigrants in 2024, according to a new report from the Department of Health and Human Services.

The report found that $759 million in Temporary Assistance for Needy Families cash assistance was provided to 85,277 households nationwide in which a child qualified for benefits while a parent was living in the United States illegally.

No state came close to California's share of spending, with $617.5 million. The second-place recipient, New York, received just $47.5 million--less than one-tenth of California's total.

Temporary Assistance for Needy Families, or TANF, was created to provide temporary assistance to low-income families. TANF recipients are generally required to work and are limited to 60 months of benefits over a lifetime.

Because parents living in the country illegally are generally ineligible for TANF benefits, assistance in these cases is provided on behalf of eligible children living in the household.

Unlike traditional TANF recipients, these child-only cases are not subject to federal work requirements or the program's five-year lifetime limit, allowing benefits to continue until a child turns 18.

The report's authors noted that the arrangement creates a disparity between American families receiving TANF and immigrant households receiving child-only benefits.

"The result is a striking disparity: needy American families are held to TANF's central work and time-limit rules, while households headed by immigration-status-ineligible parents can receive child-only cash assistance under a structure that bypasses those rules and can allow support to continue from birth through age 18."

The report estimated that affected households received an average of roughly $742 per month, or about $8,900 annually.

Between 2001 and 2024, approximately $18.3 billion in TANF assistance was distributed through these child-only cases, while their share of the total TANF caseload increased from 5.8% to 10%.

SNAP and Section 8 cost U.S. taxpayers $138 billion last year, and that is before Medicaid, SSI, and the rest. Food is expensive in part because 42 million people are buying groceries with a card someone else funded.

The damage is not only the bill. When tens of millions of people organize their month around a government check, they stop voting on the country and start voting on the benefit. Borders, crime, and debt become background noise next to the one question that matters to them: who will keep the groceries and the rent voucher flowing.

Milton Friedman put it plainly: you cannot simultaneously have free immigration and a welfare state.

That doesn't include housing, all the other benefits they get. And here in California, they don't even care. They don't even hide it.

I used to live in a neighborhood where 70% of the people around me were undocumented, and man, did they live the life. New cars, parties every weekend"

- Undocumented parents qualify for benefits on behalf of their US citizen anchor babies. This includes CalFresh (food stamps), cash aid, and up to $1,200+ per child plus extras

- California runs Cash Assistance Program for Immigrants. This is a 100% state-funded program giving monthly cash to aged or disabled non-citizens ineligible for federal SSI due to immigration status
