Appeals Court Rejects Biden's Second Attempt to Block the Release of His "Elderly Man with a Poor Memory" Interview Tapes

You're not experiencing deja-vu. Yes, there was a story like this recently, but that was the district court judge rejecting Biden's plea for an injunction blocking the release of the tapes, supposedly to protect his "privacy" by keeping secret the tapes of his conversations with his ghostwriter, with whom he shared classified information.

These tapes were in turn subpoenaed by Robert Hur and were evidence -- proof, actually -- that Biden both shared classified information with someone not cleared to hear it and that he knew he was illegally retaining classified documents, because he explicitly says something like "I'm not supposed to still have these" in the tapes.

Hur didn't prosecute, of course, even though Biden was guilty by his own admission. Hur claiming that no jury would convict this hapless husk because his brains were plainly mush. (To which I say: Put me on the jury and I'll send this decrepit muppet to the fucking gulag.)

Biden rushed out an appeal, and the Appeals Court told him that the public's interest in the actual truth trumped his fake right to keep the truth from the public in the interest of "privacy."

One might say that presidents have a very low expectation of privacy -- particularly when the tapes sought to keep private include admissions of breaking serious federal laws.

- A federal appeals court has rejected a request by Joe Biden to block the release of audio recordings and transcripts of his interviews with a memoir ghostwriter before he was elected president.

A divided three-judge panel from the U.S. Court of Appeals for the District of Columbia Circuit suspended its decision until Aug. 3 to allow more time for Biden to consider another appeal.

The panel's 2-1 ruling late Monday found there is a "substantial" public interest in disclosing the material that Biden wants to keep under wraps. Redactions to the recordings would help protect Biden's privacy, the majority noted.

Redactions? What?

"We conclude that any remaining incursion on personal privacy from disclosure of the now-redacted materials likely does not outweigh the public interest in disclosure," the ruling says.

And whose appointee was the judge who rushed to defend this elderly man with a poor memory?

Judge Florence Pan, who was nominated by Biden, a Democrat, wrote a dissenting opinion in which she said Biden has shown a "substantial privacy interest" in keeping the material hidden.

"The conversations at issue took place in Biden's home, and the recordings of them were obtained by the government in the course of a criminal investigation that did not lead to an indictment," she wrote.

The "conversations" -- in which Biden confessed to knowingly retaining classified documents -- took place at his home and this is why the tapes of this questioning are "private"?

What?

The appeal also was heard by D.C. Circuit Chief Judge Sri Srinivasan and Judge Gregory Katsas. Srinivasan was nominated by President Barack Obama, a Democrat who chose Biden as his vice president. Katsas was nominated by President Donald Trump, a Republican who lost to Biden in 2020 but was elected again to the White House in 2024.


Mark Zwonitzer, who worked with Biden on two memoirs, 2007's "Promises to Keep" and 2017's "Promise Me, Dad," interviewed him at his home in 2016 and 2017. Biden's lawyers say the conversations were candid, personal and intended to remain private.

Yes, they were "candid, private conversations intended to remain private" except that they were also had in furtherance of writing a memoir for Biden, intended for public publication. (Hey, publication has the word "public" right in it.)

That doesn't scream "private" to me.

Pan noted that the majority is effectively ruling in favor of immediately disclosing the material by denying Biden's request for an injunction pending appeal.

"That, of course, will moot this case," she wrote.
