Federal Judge in Florida Overrules DC Judge, Orders the DHS to Turn Back on SAVE's Verification System for Determining Aliens' Eligibility for Benefits -- and Voting

Remember foreign judge "Sparkle" Sooknanan? She claimed that it was unconstitution for Trump to check voter names against social security numbers to determine if they were eligible to vote.

She herself is a foreign citizen -- she has dual citizenship, and never renounced her foreign one, despite suggesting that she would if approved to be a judge -- so she's very invested in the idea that foreigners should rule United States citizens.

But not a Florida federal judge says "turn the machines back on."

He himself was the judge in a case where states sued the DHS to secure the elections, and the consent decree reached by the DHS and the states was that these safeguards were to be implemented.

So "Sparkle's" ruling contradicts a judge-approved settlement between the states and the federal government.

For that reason, he's "overruling" her.

Federal judge hands Trump big win, directs DHS to restore voter verification features of SAVE system

The SAVE system was enhanced under the Trump administration to better support state election integrity efforts, including maintenance of state voter rolls.

A federal judge in Florida on Tuesday ordered the Department of Homeland Security to restore some of the key features of its Systematic Alien Verification for Entitlements system, which states use to verify citizenship and immigration status for voter rolls.

The ruling overturns a D.C. judge's ruling, who determined that the SAVE system's features, including a feature that allowed workers to verify citizenship status through a resident's social security number, violated the Social Security Act and Privacy Act by improperly aggregating and using Americans' personal data.

The SAVE system was enhanced under the Trump administration to better support state election integrity efforts, including maintenance of state voter rolls.

U.S. District Judge T. Kent Wetherell II ruled that the DHS violated a settlement with states, including Florida, by disabling the features. Wetherell approved the settlement last year and has maintained jurisdiction to enforce the settlement.

"Defendants are plainly in violation of the settlement agreement because it is undisputed that they disabled the bulk-upload and SSN-search features that the agreement expressly required the SAVE system to have," he wrote in the order. "The fact that defendants disabled those features to comply with [the judge's] order does not change the fact that they violated the agreement."

Wetherell determined that the features did not violate federal law, concluding the SSN-search functions align with 8 U.S.C. §1373, which overrides other restrictions on sharing citizenship or immigration status information, according to Florida's Voice News.

I'm not sure how a Florida district judge can "overrule" a DC district judge, since both are equals. Appeals courts overrule district judges below them.

But this judge, overseeing the DHS/state settlement, might have some special authority to protect the settlement.

So is it over?

BREAKING: Judge 'Sparkle' Flips Out, Rejects Federal Court Order Dismissing Her Ruling

Judge Sparkle Sooknanan has refused to pause her ruling that dismantled the Department of Homeland Security's expanded SAVE citizenship verification system, even after a federal judge in Florida ordered the exact same system to be restored.

The dispute centers on the Trump administration's expanded SAVE database, which allows states to use Social Security numbers and bulk searches to verify citizenship for voter rolls and other lawful government functions.

Last month, Judge Sooknanan blocked the upgrades, ruling they violated federal privacy laws.

But because Florida, Indiana, Iowa, and Ohio had already secured a court-approved settlement guaranteeing access to those same SAVE features, U.S. District Judge T. Kent Wetherell II ordered DHS to immediately restore them.

Rather than pause her ruling while the conflict plays out, Judge Sooknanan rejected the Trump administration's request, accusing the government of "gamesmanship" and insisting the Florida court had "erred in significant ways."

The conflicting rulings now leave DHS in the position of being ordered by one federal judge to disable the system or to ignore her and follow the alternate judge's ruling.

Rep. Abe Hamadeh has introduced articles of impeachment against Judge Sooknanan.

Rep. Nancy Mace has proposed legislation requiring federal judges, members of Congress, and Senate-confirmed officials to be natural-born U.S. citizens.

Judges Flo Pan (Biden) and Robert Wilkins (Obama) claimed the DOT "does not appear to have demonstrated any safety benefit from the rule [and] the county petitioner has furnished evidence that the rule would harm public safety by forcing it to replace safer experienced drivers with less-safe new drivers."
