200,000 Deportation Cases Dismissed Because Biden Admin Failed To File Paperwork

Illegal immigrants 'effectively left in legal limbo without any way to pursue asylum,' says non-partisan data analytics group

Um, they were schedule for deportation. I'd say "legal limbo" is a boon for them.

The Biden administration failed to file court papers in hundreds of thousands of deportation cases, which were as a result tossed by judges.

The Department of Homeland Security enforces immigration laws by issuing a Notice to Appear (NTA) to each illegal immigrant and filing it in court. But in approximately 200,000 cases in which NTAs were issued to aliens at the border, triggering the creation of a court date, DHS never filed the actual paper with the court, according to new data obtained by the Transactional Records Access Clearinghouse, an academic group better known as TRAC.

In immigration courts in Houston, Texas, and Miami, Florida, both immigration hotbeds, more than half of their deportation cases have been dismissed for that reason since fiscal year 2021.

"These large numbers of dismissals and what then happens raise serious concerns," the nonpartisan group, affiliated with Syracuse University, said in its report. The percentage of immigration cases that were dismissed skyrocketed immediately upon President Joe Biden taking office, rising from 0.1% in 2017 and 1.2% in 2019 to 10.6% in 2021.

The percentage of cases dismissed has shrunk since that peak, but with the number of illegal border-crossers at record highs, the actual number of dismissals was far higher in 2022 and 2023 than at any time on record.

If the case is dismissed because the government has not filed paperwork by the time the court date rolls around, the government can simply file a new case against the alien. But TRAC obtained data that allowed it to see that nearly 75% of the time, DHS never bothered to do so.

That has remained constant through Biden's term. And, in some cases, what would appear to be a clerical mistake is virtually never corrected: At the DHS' Baltimore location, it made a second attempt at deporting the alien only 2% of the time.

TRAC previously reported that 50,000 asylum files mysteriously disappeared, allowing the Biden administration to "falsely report that its asylum backlog had been reduced this past year when in fact it had markedly grown."

Meanwhile, the head of Health and Human Services admits that the Biden Administration released 300,000 unaccompanied minor illegal aliens into the US since this corrupt bunch seized power.

Republicans grilled HHS Secretary Xavier Becerra for details on the extent to which immigrant children have come over the border and been released into the country, including to unrelated adults, rather than being deported back to their home countries.

"Probably over 300,000 in the last three years or so," Becerra said in a rare public admission about the magnitude of the border crisis. No previous administration, including two-term presidents, have released as many children.

The figure is on par with data on the HHS website, which indicates 392,000 children have been let go to sponsors in the United States since October 2020, which includes the final four months of the Trump administration.

The number pales in comparison to even previous two-term presidential administrations and exemplifies the effect that the border crisis continues to have, not just on border authorities but on unrelated agencies.

A Washington Examiner analysis of U.S. Customs and Border Protection data revealed that more than 464,000 unaccompanied minors have been apprehended at the border between Biden's first full month in office in 2021 and January 2024.

Immigrant children began arriving alone at the southern border early on in Biden's term following the Department of Homeland Security's decision not to return children to Mexico, as had been the Trump administration's protocol during the pandemic.

The border is being overrun, with entitled criminal aliens tearing through our (deliberately weak) border fences.

In El Paso, Texas, a large group of migrants clashed with the Texas National Guard, breaking through barriers and tearing through razor wire.

A suspected member of the notorious MS-13 street gang is accused of sex trafficking a 17-year-old migrant girl he recruited out of a Queens shelter -- while still on the lam for allegedly fondling a 9-year-old girl years earlier.

Alfredo Morocho, 37, who was also hit with a bail jumping charge for skipping out on the 2018 child molestation case, is finally being held on Rikers Island without bail, according to officials and court records.

He is now charged with two counts of sex trafficking of a child, five counts of promoting prostitution and two counts of patronizing a person in prostitution in the new case.

Over the following four months, he allegedly coerced the girl into prostitution, driving her to and from a Corona apartment for dates with johns, giving her half the money she collected at the end of the day, prosecutors said.

Morocho also coaxed the teen to give him semi-nude photos of herself that he would send to prospective customers, according to prosecutors.

Morocho -- who authorities believe is tied to MS-13 because of several distinctive tattoos -- first got jammed up nearly six years ago when he was charged with fondling the younger girl outside a Queens mobile phone shop on Sept. 26, 2018.

A Hispanic lady got up and spoke, and she had gone to work at the Border as a government employee being an interpreter with all of the influx of the illegal immigrants coming across. Her job was to register all of them for Medicaid. Then part of her job per the Biden administration was to ask them, "do you want to register to vote." If they want to register to vote she had to register them to be a voter with no ID.

She also said that they were not required to have insurance on a vehicle, they got $600 a month and many other things. Free!! She said she took it as long as she could, and she had to quit her job. She could not do this with a clear conscience. She said I am Hispanic. I am here legally, and I don't get those free things, so this is how Biden works, she told our representatives that were there, this is what she was required to do by the Biden administration.I'm asking everyone to share this, it's not a rumor, I was there.
