The judge chaperoning the Fani-Sweetdick Work Affair has dismissed six charges against Trump and his co-defendants, without prejudice, meaning that the charges can be re-indicted, but this will take time.

Note this is not connected with the motion to disqualify Fani and Sweetdick. This was another motion the judge has decided to dispose of.

The reason for the dismissal, via a "special demurrer," is that the allegations are so vague that no defendant charged with such vague claims would be apprised of what exactly he's claimed to have done, and when he's claimed to have done it. This denies the defendants the ability to properly defend themselves.

If the incompetent F*ck Buddies Fani and Wade can ever get their sh*t together to bother telling the defendants exactly what they're accused of, they may re-impanel a grand jury and re-indict.

The judge overseeing former President Donald Trump's Georgia election interference case has dismissed some of the charges against the 2024 Republican presidential nominee, dealing a damaging blow to Fulton County District Attorney Fani Willis.


Judge Scott McAfee, who's also presiding over the disqualification proceedings facing Willis, wrote in a nine-page court order Wednesday that six of the charges filed in the grand jury indictment must be quashed, including three against Trump.

The defense challenged the charges via special demurrer, which challenges the form of an indictment as ambiguous by asserting that the defendant is entitled to additional information or specificity. In general, demurrers provide a means for the accused to ensure that the state's charging documents satisfy the constitutional mandates of due process and the Sixth Amendment.

"The Court's concern is less that the State has failed to allege sufficient conduct of the Defendants," McAfee wrote. "In fact, it has alleged an abundance. However, the lack of detail concerning an essential legal element is, in the undersigned's opinion, fatal."

I don't like that he says Fani and Sweetdick have alleged "an abundance" against Trump and the co-defendants.

"As written, these six counts contain all the essential elements of the crimes but fail to allege sufficient detail regarding the nature of their commission [...] They do not give the Defendants enough information to prepare their defenses intelligently, as the Defendants could have violated the Constitutions and thus the statute in dozens, if not hundreds, of distinct ways..."

I believe the problem comes when Fani and Sweetdick say that Trump and the codefendants "improperly demanded or importuned" election officials to do this or that. He's saying, you have to be more specific about the wrong acts you're claiming they actually committed. They "importuned" election officials? How? In what way? What did they say? What were the parts of this "importuning" that you claim are "improper" and illegal? When did they supposedly so "importune" officials?

If Fani and Sweetdick have more specifics about these importunings, they may refile.

But there are questions of timing which will vex the Adulterous Avengers.

Judge McAfee dismissal of the six counts presents a difficult question for the prosecution. If they try to secure a superseding indictment to correct the earlier mistakes, it will make it difficult to try the case before the election...

...The defense is allowed discovery and time to prepare for the new alleged crimes. That will take time off the clock. The court has indicated that they can still rely on the underlying conduct to make out the general racketeering charge. However, that theory was alreadly thin...

...Part of the value of the multiplicity of counts was to convey a pattern criminality as a foundation for the more serious racketeering charges. This does not disable the case, but it adds yet another set back for the prosecution as it awaits the disqualification decision.

Via Hot Air, even a CNN "legal analyst" is blasting Fani Willis for thinking with her snizz. His words, not mine. (Well not really but it's implied.)

Honig referred to the new development in the case as just the latest in a series of "screwups" by Willis.

"There have been several screwups, frankly, by the DA throughout the history of this case. Going back to the investigative phase, the DA got herself disqualified from a small piece of the case because she created a political conflict of interest," he said. "The judge who was overseeing the grand jury removed Fani Willis from the case. We've seen Fani Willis make public statements in the church and elsewhere that have now been called into question that I think violate the ethics of prosecutorial rules and now we've seen six of the charges thrown out of the case and unlike the conflict of interest issue, this does go to the charges against the defendant. This does go to the indictment itself."


Colorado Republican representative Ken Buck resigns from Congress, not even bothering to serve out his term before the election, despite Republicans' thinnest-of-thin majority.

Buck, a member of the Freedom Caucus, announced his intent to retire from Congress in November. He doesn't seem to have given anyone a heads-up about his plans.

Speaking to reporters shortly after the news broke, Johnson suggested he did not get a heads-up from Buck.

"I was surprised by Ken's announcement. I'm looking forward to talking with him about that," the speaker said.

Other GOP colleagues said they were taken aback by Buck's decision. "Very surprising, very disturbing, very alarming, very concerning," said Rep. Pat Fallon, R-Texas.

His departure reduces the House GOP majority to 218-213, meaning that Speaker Johnson has a total of two votes he can lose before depending upon the kindness of Hakeem Jeffries to pass legislation.

Not a single Democrat witness was able to say that illegal aliens should not vote in federal elections at a Congressional hearing about the Orwellian-named "John Lewis Voting Rights Act."

None of Democrats' witnesses in a congressional hearing Tuesday could say resolutely that they believe only citizens should be able to vote in a federal election.

During a Senate Judiciary Hearing on the John Lewis Voting Rights Act, Republican Utah Sen. Mike Lee asked the witnesses to provide a basic "yes" or "no" answer to a series of questions about non-citizens voting.

"Do you believe that only citizens of the United States should be able to vote in federal elections?" Lee asked each of the witnesses.

"We don't have a position about non-citizens voting in federal elections, we believe that's what the current laws are, and so we're certainly fighting for everyone who is eligible under current law to vote," Executive Director of The Lawyers' Committee for Civil Rights Under Law Damon T. Hewitt said.

"That's a decision of the state law but I want to emphasize --" President of Southwest Voter Registration Education Project Lydia Camarillo said.

"It's a decision of state law as to who should vote in federal elections?" Lee interjected.

"States decide who gets to vote in various elections, and in federal elections I believe that we should be encouraging people to naturalize and then vote," Camarillo said.

"Okay but you're saying that the federal government should have no say in who votes in a federal election?" Lee pressed.

"I don't have a position on that," Camarillo responded.
