Obama's "Dear Colleague" Demand for No-Due-Process Rape Courts Rescinded

Big news. Expected, but big.

"This interim guidance will help schools as they work to combat sexual misconduct and will treat all students fairly," DeVos said. "Schools must continue to confront these horrific crimes and behaviors head-on. There will be no more sweeping them under the rug. But the process also must be fair and impartial, giving everyone more confidence in its outcomes."

Here's a bit that I've only seen Duke Lacrosse Rape case debunker KC Johnson highlight --


If you can't read it, it says that the standards/procedure used in these Title IX courts must be the same for adjudging other offenses. So universities can't run sexual assault hearings with any less procedural safe guards than those employed in other contexts.

Related, in a way:


An illegal immigrant is accused of raping a six year old girl.

Now, answer this for me:

If it's okay to use hearings which lack due process, review of the evidence, provision of a lawyer, etc., to expel students from college on sexual assault colleges, why can we not similarly dispense with due process rights when seeking to eject accused-but-not-yet-convicted illegal aliens from the US?

If the former passes constitutional muster, then so does the second. (Federally subsidized schools must respect rights to the same extent as the government -- and if they don't have to respect rights, then, ipso facto, neither does the government.)

And if its required to drop evidentiary standards down to near-zero to protect alleged victims in college, why is not necessary to do the same to protect the population generally?

Why do we have to wait for a full court/full due process conviction to eject an accused alien illegally present in the US, when it is now the left's insistence that no such procedural safeguards are needed to throw a US citizen out of a college?
