Obama Asks 11th Circuit for Expedited Review, Per Judge Vinson's Order
They filed last night, I believe.
Vinson's order struck me as wishy-washy and not nearly as tough as it sounded. In tone it was tough. In actual directive it was... cautious.
It seemed to me that Vinson was saying that ObamaCare was unconstitutional and its implementation must be halted as illegal... unless Obama filed for expedited review.
Since he did that, I assume that means implementation will go forward while courts rule on the matter.
That may be a prudent route but it does defer to Obama during this period of judicial review. Vinson's order sounded tougher than it was, I think.
The earliest ruling, NRO says, will be June or July. Presumably then the Supreme Court could take the matter up before the end of the year -- or decide it, effectively, without a decision by not granting certiorari (review) to the loser in the 11th circuit.
The 11th Circuit is described, an article said, as "moderate," so those (like me) hoping a court based in the South would be conservative are a little disappointed.
